المستخلص: الزواج مؤسسة شرعتها الأديان السماوية والوضعية لكي يستقيم المجتمع وعليه يعول في بناء الأسرة التي هي عماده، والحياة الروحية تنبثق عن طريق الزواج باعتباره ارتباط بين اثنين في بقية حياتهما، فقد شرع المشرع الحكيم الطلاق الذي هو انفصال الزوجين رسميا وإنهاء العلاقة فيما بينهما فالمعاملة الحسنة التي يقوم بها الزوج لزوجته تساهم في بناء نسيج قوي من العلاقات الطيبة والترحم والمودة فالطلاق يأتي من زوجية لا جدوى في بقائها وزوالها أفضل من استمرارها لأن الجفوة تحل محل الطيبة والتراحم والمودة فتصبح الحياة الزوجية محل للتعب والخصام والشقاء. أصبح الطلاق اليوم ظاهرة تهدد كيان الأسرة أولا والمجتمع ثانيا بسبب تظافر عدة عوامل ساعدت على انتشار هذه الظاهرة منها عوامل اقتصادية وأخرى اجتماعية، وعوامل نفسية ومرضية، وأخرى ثقافية، تداخلت هذه العوامل فيما بينها لتسبب العديد من حالات الطلاق، لقد أباح الإسلام الطلاق في ظروف معينة وشروط فيكون بذلك مخرجا من الشدة والضيق على الرغم من أنه أبغض الحلال عند الله عز وجل لأن الله سبحانه وتعالى أراد أعفاف الزوجين وضبط شرفهما من فوضى اختلاط الأنساب وحفظ النسل وزيادته بديمومة الزواج وبالتالي الطلاق يعود بآثار سلبية على الزوجين وكذلك على الأبناء من الضياع وسط البيئات السلبية والسلوكيات المنحرفة والتسرب من التعلم وجميع الالتزامات التي تعد كآثار متوقعة لما بعد الطلاق. أن الأسرة التي كان مصيرها الطلاق يرجع أيضا لأسباب داخلية وخارجية أصبحت صورة مشجعة لانتشار هذه الظاهرة منها مظاهرة البطالة والفقر والحرمان، كما تأخذ التدخلات الخارجية من هنا وهناك (الأهل أو الأقارب) دورا في تفتيت وحدة الأسرة وتماسكها وبالتالي عجز الزوجين من التوافق والتفاهم لحل الخلافات المستمرة يحمل معنى واحد هو نقص في فهم وإدراك الزوجين لمعنى مسؤولية الحياة الزوجية وهذا الأمر يساهم في زيادة حالات الطلاق التي لا يقتصر تأثيرها على الأسرة فقد بل يؤثر على النسيج الاجتماعي فقد تمتد أحيانا إلى الخلافات التي تنجم عنها خسائر بشرية بسبب التركيبة العشائرية والعرف الاجتماعي.

The wise legislator legislated divorce, which is the formal separation of the spouses and the termination of the relationship between them What the husband performs for his wife contributes to building a strong fabric of good relations, mercy and affection. Divorce comes from a marriage whose survival and demise is not better than its continuation, because estrangement replaces kindness, compassion and affection, so marital life becomes a place of fatigue, contention and misery. Divorce today is a phenomenon that threatens the family entity first and society Secondly, because of the combination of several factors that helped the spread of this phenomenon, including economic and social factors, psychological and pathological factors, and cultural ones. It is the most hated lawful in the sight of God Almighty, because God Almighty wanted the couple to be chaste and control their honor from the chaos of mixing lineages and preserving people Because and its increase in the permanence of marriage and consequently divorce has negative effects on the spouses as well as on the children from being lost in the midst of negative environments, deviant behaviors, dropping out of education and all obligations that are considered as expected effects of post-divorce. Including the manifestation of unemployment, poverty and deprivation, as external interventions from here and there (fathers or relatives) take a role in the fragmentation and unity of the family and its cohesion, and consequently the inability of the spouses to agree and understand to resolve the ongoing disputes carries one meaning which is a lack of understanding and the spouses’ awareness of the meaning of the responsibility of married life and this matter contributes In the increase of divorce cases, whose impact is not limited to the family, but rather affects the social fabric, it may sometimes extend to disputes that result in human losses due to the clan structure and social custom.
