المستخلص: لا هم للبشرية إلا العيش بسعادة وطمأنينة في مجتمع آمن عادل، وهذا لا يمكن أن يتحقق إلا بمحاصرة الجرائم والأخذ على أيدي المعتدين الذين يهددون أمن المجتمع، وينشرون في الأرض الفساد، ومن ثم فقد شرعت الزواجر بعقوباتها المتنوعة؛ لردع المعتدين، وإصلاح المفسدين. والزواجر الشرعية، هي حكم الله الرحيم بعباده، العليم بالطبيعة الإنسانية وما جبلت عليه من معصية وضعف أمام الشهوات والمغريات، والله تعالى أعلم بما يصلح أحوال الناس وينفعهم في الدنيا والآخرة. والزواجر الشرعية على شدتها، تحمل في ثناياها الرحمة بالأفراد والجماعات؛ لأنها تمنع الجريمة قبل وقوعها، وتحافظ على حقوق الجميع. وقد ركز هذا البحث على تناول الزواجر الشرعية الثابتة، وبيان مدى رحمتها بالإنسانية وحفظها لحقوق المعتدي عليهم والمعتدين، مع بيان مدى رحمة الشريعة الإسلامية بالجناة التائبين، وحثها على سترهم، وقد جاء البحث مدعوما بالأدلة الشرعية، والوقائع الصحيحة من سيرة الرسول وصحابته الكرام، وآراء فقهاء المسلمين وعلمائهم الموثقة من مصادرها الأصلية، مع الموازنة بينها، وإظهار الرأي الأقرب إلى روح ديننا الحنيف ورحمته.

There is no concern for humanity except to live with happiness and reassurance in a fair, safe society, and this can only be achieved by besieging crimes and taking the hands of the aggressors who threaten the security of society, and spread on the land corruption, and then the borders were launched with its various boundaries; To deter the aggressors, and reform the spoilers. Sharia’s boundaries are Allah's judgments, the Most Merciful of his servants, and the most knowledgeable of the human nature and the disobedience and weakness of it in front of desires and temptations, and Allah Almighty knows what works for people and benefits them in this world and the hereafter. And Sharia’s boundaries in its severity, carry mercy on individuals and groups in its folds; Because it prevents crime before it occurs, and preserves the rights of everyone. This research focused on addressing the established Sharia’s boundaries, and demonstrating its mercy for humanity and its preservation of the rights of the victims and the aggressors, with an indication of the mercy of Islamic law in the repentant perpetrators. The research is supported by legitimate evidences, the correct facts from the biography of the Prophet and his esteemed companions, and the opinions of Muslim jurists and scholars that are documented from original sources, with the balance between them, and showing the opinion closest to the spirit and mercy of our religion.
