المستخلص: إن مما حباه الله لدين الإسلام أن شرع شرائع، وسن سنن، ووضع أحكام بها تستقيم أمور حياة البشرية دينا ودنيا، ومن تلك الأحكام: القاعدة المقاصدية (يتحمل الضرر الخاص لدفع الضرر العام) والتي تحمل في طياتها، ومعانيها، ومضامينها، مسائل عدة تبين مكانة الشريعة الإسلامية، وصلاحيتها زمانا ومكانا، وأن آثارها مرتبطة ارتباط وثيق بالضروريات الخمس التي اتفقت عليها الشرائع السماوية من خلال حفظ النفس، والعقل، والدين، والعرض، والمال. لذا اتجه البحث لبيان التعريف بالقاعدة من الناحية اللغوية والاصطلاحية، وبيان العلاقة بين القاعدة والقاعدة المقاصدية الأخرى (درء المفاسد مقدم على جلب المصالح)، والوقوف على الآثار المقاصدية للقاعدة، وبيان تطبيقاتها الفقهية في جائحة كورونا، وكذلك الوقوف على بيان سمة الشريعة الإسلامية وأنها صالحة للتنزيل الواقعي زمانا ومكانا وذلك من خلال الآثار التي أكدتها القاعدة المقاصدية، ومن ثم ختم البحث بخاتمة اشتملت على أبرز نتائج البحث وتوصياته، كان من أهمها: 1. أن قاعدة (يتحمل الضرر الخاص لدفع الضرر العام) قاعدة ذات أبعاد مقاصدية تساهم عن طريق التنزيل في تفعيل دور الاجتهاد المقاصدي. 2. أن قاعدة (يتحمل الضرر الخاص لدفع الضرر العام) ذات علاقة وطيدة بقاعدة (درء المفاسد مقدم على جلب المصالح)، من كون الإلزام بإيقاع الضرر الخاص من أجل دفع الضرر العام بولي الأمر. ٣. التطبيقية والنتائج التي تحققت في بلدان العالم كان سمة بارزة من أن مردود تلك الإجراءات هي: أن هذه الشريعة الإسلامية صالحة للتطبيق زمانا ومكانا، وهذا ما أكدته هذه القاعدة. ٤. النظر المقاصدي لهذه القاعدة يساهم في نشر التطبيق المقاصدي للأحكام الشرعية.

Among what God has endowed to the religion of Islam is that he legislates laws, enacts laws, and sets rules by which the affairs of human life are straightened, religiously and in this world, and among those provisions: the intentional rule (bearing private harm to ward off public harm), which carries in its folds, meanings, and implications, several issues that show the status of Sharia Islamic law, its validity in time and place, and that its effects are closely related to the five necessities agreed upon by the heavenly laws through the preservation of the soul, the mind, religion, honor, and money. Therefore, the research turned to clarifying the definition of the rule from a linguistic and idiomatic point of view, and to clarify the relationship between the rule and the other intentional rule (preventing evil takes precedence over bringing benefits), and to stand on the intentional effects of the rule, and to clarify its jurisprudential applications in the Corona pandemic, as well as to stand on the statement of the characteristic of Islamic Sharia and that it is valid for download Realistic time and place, through the effects confirmed by the intentional rule, and then concluded the research with a conclusion that included the most prominent results and recommendations of the research, the most important of which were: 1. That the rule (particular harm is to be borne to pay the general harm) is a rule with intentional dimensions that contributes, through download, to activating the role of intentional ijtihad. 2. That the rule (special harm is to be paid to pay public harm) is closely related to the rule (preventing harm takes precedence over bringing interests), from the fact that the obligation to inflict private harm in order to pay the general harm is the guardian. 3. Applied and the results achieved in the countries of the world was a prominent feature that the returns of these procedures are: that this Islamic Sharia is valid for application in time and place, and this is what was confirmed by this rule. 4. The intentional consideration of this rule contributes to the dissemination of the intentional application of Shariah rulings.
