المستخلص: تناول هذا البحث تأملات في المسؤولية المدنية للمحكم في القانون المصري والنظام السعودي، وكان ذلك في مقدمة وثلاثة مباحث، الأول: في التزامات المحكم، والثاني: في المسؤولية العقدية للمحكم، والثالث: في المسؤولية التقصيرية للمحكم، تناول المبحث الأول التزامات المحكم التي تسبق النزاع، والتزاماته أثناء نظر النزاع، والتزاماته بعد نظر النزاع، وفي المبحث الثاني تناولت المسؤولية العقدية للمحكم شروط قيامها، ومناطها، وأركانها، وفي المبحث الثالث تناولت المسؤولية التقصيرية للمحكم من حيث أركانها، وأساسها، والجهة المختصة بنظر دعاوى المسؤولية المرفوعة من ذوي الشأن ضد المحكمين، والجزاءات التي يمكن توقيعها على المحكم في حال ثبوت مسؤوليته، وختمت البحث بمجموعة من النتائج التي توصلت إليها والتوصيات التي أوصي بها.

This research dealt with reflections on the civil liability of the arbitrator in the Egyptian law and the Saudi system, and this was in an introduction and three sections, the first: on the obligations of the arbitrator, the second: on the contractual responsibility of the arbitrator, and the third: on the tort responsibility of the arbitrator, the first section dealt with the obligations of the arbitrator that precede the dispute, And his obligations during the consideration of the dispute, and his obligations after the consideration of the dispute, and in the second topic, the contractual responsibility of the arbitrator dealt with the conditions of its establishment, its premise, and its elements, and in The third topic dealt with the tort responsibility of the arbitrator in terms of its elements, its basis, the competent authority to consider the liability claims filed by the stakeholders against the arbitrators, and the penalties that can be imposed on the arbitrator if his responsibility is proven, and concluded the research with a set of findings and recommendations that I recommend.
