|a يعالج هذا البحث مسألة الإجماع الذي استقر عليه الأمر بعد خلاف تقدمه، وتم التمهيد لذلك بالتعريف بالإجماع واعتباره دليلا من أدلة الشرع، وإمكانية انعقاده، وحجيته، وفائدته، وحكم المخالف له، وما ضابط المخالفة المؤثرة في خرق الإجماع؟ وما أنواعه؟ ثم ركز البحث على نقطة من هذه النقاط وهي مسألة: الإجماع المسبوق بخلاف. فتناولها بشيء من البسط والتفصيل؛ إذ عليها مدار الكلام، ومقصود المقال. ولها صور وحالات، بحسب الزمن الذي وقع فيه الخلاف؛ إذ فرق بين ما إذا كان الخلاف واقع في زمن الصحابة وبين ما إذا كان بعدهم، وبين ما إذا كان قد حصل الإجماع قبل انقراض الصحابة، وبين ما إذا كان هذه فيمن بعدهم. فالزمن هنا عامل مهم في الاعتداد بالإجماع أو عدم الاعتداد به. وصاحب ذلك التطبيق على مسائل فقهية، حكي فيها إجماع مسبوق بخلاف. تم اقتناص هذه المسائل من كلام إمام من أئمة الشأن وهو الإمام النووي رحمه الله، من خلال شرحه على صحيح الإمام مسلم. وقد وقع عامة هذه المسائل في قسم العبادات. وذلك في كتاب الطهارة، وكتاب الصلاة، وكتاب الزكاة، وكتاب الصوم، وكتاب الحج.

Among its types is the subject of research, which was preceded by a dispute, and it has images and cases, according to the time in which the dispute occurred; If a difference is made between whether it was the time of the Companions and whether it was after them, then the time here is an important factor in the adoption of consensus or not. This application was accompanied by a jurisprudential issue, in which a consensus preceded a dispute.. These issues were extracted from the words of one of the imams in the matter, Imam Al-Nawawi, may God have mercy on him, through his explanation on the Sahih of Imam Muslim.
