المستخلص: يتناول البحث الفتوى زمن الفتن العامة في الأمة، الذي يحتاج زيادة تثبت وعناية بها وبمن تؤخذ عنه من المتصدرين لها، بإبراز عدد من المعايير والضوابط التي تعين على ذلك؛ لأن الفتوى زمن الفن تنبني عليها أمور خطيرة، ولها أثر كبير في سير أحداث الفتنة نحو الأفضل أو نحو الأسوأ، والتمييز بين أنواع المفتين وطبقاتهم والدخيل عليهم، مع التركيز على إبراز خصائص ومعايير من يختص بالفتوى زمن الفن، وبعض العوارض الطبيعية في البشر التي يتعين مراعاتها عند الأخذ عن المفتي في أمور الفتن، وبيان حقيقة بعض ما يغري المستفتي بأخذ الفتوى في الفتن مما لا اعتبار له في نظر الشرع كالصلاح والزهد ونحوهما، وضرورة التفريق بين التعامل مع النص الشرعي بالخضوع المطلق له، وفتوى العالم المعرضة للخطأ والصواب، وبيان حقيقة مطردة أن كل فتاوى الفتن العامة والدماء في الأمة تبين خطؤها في آخر الأمر وآلت إلى خراب ودمار، فلا داعى لتكرارها أو الاستشهاد ببعض النماذج منها ولو كانت من أهل القرون المفضلة؛ حتى لا يقع المسلمون في نفس المآسي والأحداث الأليمة التي ما زالوا يتجرعون مرارتها ليوم الناس هذا. أهداف البحث ١- جمع ضوابط ومعايير في الفتوى والمفتي، تعين المسلم على معرفة دينه أيامه الفتن. ٢- إبراز بعض الخصائص والمعايير فيمن تعتبر فتواه في أمور الفتن العامة. النتائج: ١- الفتن لا يظهر خطرها إلا بعد زوالها. ٢- هناك معايير مهمة يمكن للناس الاستفادة منها زمن الفن في التعامل مع الفتوى. التوصيات 1- أوصى الباحثين بزيادة إثراء موضوع الفتوى من جوانبه العقدية المختلفة. ٢- أوصى طلبة العلم بعدم التشويش على الأمة في الأحداث الكبرى.

The research deals with the fatwa at the time of public strife in the Ummah, which needs more confirmation and attention to it and to those who are muftis about it, by highlighting a number of criteria and rules that help Muslims to do so; Because the fatwa in the time of temptation entails catastrophic matters, and has a great impact on the course of the events of the temptation for the better or for the worse, differentiating between the types of muftis and their classes and those outside them, and focusing on highlighting the characteristics and criteria of those who specialize in fatwas in the time of temptation, and some natural symptoms in humans that must be taken into account when Taking from the mufti in matters of temptation, and clarifying the reality of some of what tempts the fatwa to take a fatwa in temptation that is not considered in the eyes of Sharia, such as righteousness and piety and the like, and the necessity of the difference between dealing with the Qur’anic text with absolute submission to it, and a scholar’s fatwa that can be written true or false, and clarifying It is a general fact that all the fatwas of public strife and bloodshed in the nation turned out to be wrong in the end, and their bad effects remain to this day. research aims 1- Collecting rules and criteria in the fatwa and the mufti, which help the Muslim to know his religion during his days of temptation. 2 -Highlighting some of the characteristics and criteria of the accepted fatwa in matters of public sedition. Results: 1- The danger of temptation does not appear until after it is over. 2- There are important criteria that people can benefit from in the time of temptation in dealing with fatwas. Recommendations 1- I recommend the researchers to further enrich the subject of the fatwa from its various doctrinal aspects. 2- I advise students of knowledge not to disturb the nation during major events.
