الحمد لله رب العالمين والصلاة والسلام على سيدنا محمد وعلى آله وصحبه أجمعين، فقد شهد العالم تطورات هائلة في شتى ميادين الحياة، وكان للأحوال الشخصية نصيب من هذه التطورات، فظهرت مواقع وتطبيقات متخصصة تقدم خدماتها للشباب والفتيات بغرض التعارف من أجل الزواج، وانتشرت هذه الظاهرة وكثر التعامل معها نتيجة التطور الإلكتروني، وضغوط الحياة الاقتصادية، وانتشار البطالة، والعنوسة، وأحببت أن أتناول بالبحث حكم التعامل مع هذه التطبيقات والمواقع من أجل الزواج، واستخدمت في البحث المنهج الاستقرائي، والمنهج الوصفي والتحليلي. وجاء البحث في مقدمة، وتمهيد، تناولت فيه أهمية التقنيات الحديثة واستخداماتها في حياتنا، وتناولت في المبحث الأول مفهوم مواقع وتطبيقات الزواج الإلكترونية، ونشأتها وأنواعها، وكان المبحث الثاني في بيان الأحكام الفقهية لمواقع وتطبيقات الزواج، فتكلمت فيه عن حكم أنشاء مواقع وتطبيقات الزواج، وحكم البحث عن زوج، أو زوجة عبر مواقع الزواج، وحكم الرؤية بوسائل الاتصال الحديثة لمن يريد الخطبة، وحكم إجراء عقد الزواج بوسائل الاتصال الحديثة. في المبحث الثالث تكلمت عن تطبيق تزويج وإجراء التسجيل فيه، ومميزاته، والفرق بينه وبين تطبيقات زواج الإماراتيين الأخرى، وفي الخاتمة ذكرت أهم النتائج منها: 1-جواز أنشاء مواقع وتطبيقات الزواج التي يشرف عليها الصالحون من أهل الورع والتقوى، الذين يحتاطون لها، ويتخذون كل التدابير لحمايتها. 2-الأصل أن يعلن الرجل عن رغبته في الزواج، ويجوز للمرأة أن تعرض نفسها للرجل الصالح عبر مواقع الزواج، على أن لا يصاحب الإعلان أشياء محرمة. 3-تطبيق تزويج يمثل مبادرة منضبطة بالضوابط الشرعية، ويمهد الطريق للبحث عن شريك الحياة. وأوصى البحث المشرع في البلاد العربية والإسلامية لتقنين أحكام الزواج بوسائل الاتصال الحديثة.
The world has witnessed tremendous developments in various fields of life, and personal status has had a share of these developments. Specialized websites and applications have appeared that provide services to young men and girls for the purpose of acquaintance for marriage. This phenomenon has widely spread and dealt with as a result of electronic development, and the pressures of economic life as well as the spread of unemployment and spinsterhood. This research paper will be focused on the ruling of dealing with these applications and websites for the sake of marriage. Inductive, descriptive and analytical methods will be used. The research consists of an introduction, a preface and three sections, in which it deals with the importance of modern technologies and their applications in our lives. The first section deals with the concept and applications of electronic marriage sites, their origin, and types. The second section is a statement of the jurisprudential rulings for marriage sites and applications, in which I discussed the ruling on establishing marriage websites, applications, and the ruling on searching for a husband or wife through Marriage sites. The ruling on seeing each other through modern means of communication for those who want to get engaged, and the ruling on conducting a marriage contract using modern means of communication. The third section discusses the marriage application as well as the registration procedure, its advantages, and the difference between the new and old one, such as the Emirati marriage applications, and in the conclusion, I mentioned the most important results including: 1-It is permissible to establish marriage websites and its applications that are supervised by righteous people of piety, who look after and take all measures to protect them. 2-The basic principle is that a man announces his desire to marry, and a woman is permitted to expose herself to the prospect of marriage through marriage sites, provided that the announcement is not accompanied by forbidden things. 3-Marriage application represents a disciplined initiative with Shariah controls, and paves the way for the search for a partner of life. The legislatives in Arab and Islamic countries are highly recommended to codify the provisions of marriage by modern means of communication.
