المستخلص: يهدف هذا البحث إلى عرض تجربة الجزائر بصفة عامة وموقف العدالة بصفة خاصة من خلال التطور التكنولوجي في مجال الاتصالات والمعلوماتية، التي ساهمت في تطور موقف العدالة من خلال تفعيل الإجراءات القضائية بشكل سريع خاصة فيما يتعلق إجراءات المحاكمة باستعمال تقنية المحادثة عن بعد التي كرسها المشرع بموجب قانون 15/03 المتعلق بعصرنة العدالة والتي بقي العمل بها بصفة محتشمة، إلا أنه مع تفشي جائحة كورونا أصبحت هذه التقنية ضرورة حتمية لحسن سير العدالة وتطبيق قواعد الحجر الصحي وأصبح الوضع يستلزم استعمال تقنية التقاضي عن بعد، من أجل الوقاية من انتشار الفيروس والاعتماد على أسس الوقاية والمتمثلة في التباعد الاجتماعي ما بين الأفراد، وقد أخذت العديد من دول العالم بنظام التقاضي عن بعد، ومن بينها الجزائر التي كرست واقع تطبيق العدالة الرقمية في قضائها كما جسدت المحاكمة الجزائية عن بعد.

This research aims at presenting the experience Algerian judicial system in the field of technological communication .This has contributed to the development of the system through the acceleration of the judicial proceedings, especially with regard to the trial proceedings, using the remote conversation technology agreed upon by the legislature under the Act 15/03to modernize justice. It has remained underused nevertheless. However, with the outbreak of the Corona pandemic, this technique became an imperative necessity for the proper functioning of justice and the application of the rules of the health quarantine. The situation necessitated the use of remote litigation technology to prevent the spread of the virus and to insure the social distancing precaution. Many countries of the world have introduced remote litigation, including Algeria, which has adopted digital justice procedures through remote trials.

Cette recherche vise à présenter l'expérience de l'Algérie en général et la position de la justice en particulier à travers le développement technologique dans le domaine des communications et de l'informatique, qui a contribué au développement de la position de la justice à travers l'activation rapide des procédures judiciaires, notamment en ce qui concerne les procédures de jugement utilisant la technologie de conversation à distance qui a été mise en place par le législateur en vertu de la loi 3/15 Concernant la modernisation de la justice. Cependant, avec l'éclosion de la pandémie Corona, cette technologie est devenue un impératif pour le bon fonctionnement de la justice et l'application des règles de quarantaine. Afin de prévenir la propagation de nombreux pays ont pris Le monde du contentieux à distance, dont l'Algérie, qui consacre la réalité de l'application de la justice numérique dans son système judiciaire et incarne le procès pénal à distance.
