|a على الرغم من أهمية التنظيم القانوني لإجراءات الرقابة على عمليات التركز الاقتصادي من قبل المشرع في الدول المختلفة، إلا أن الجهود المبذولة في هذا الصدد تبقى في إطارها النظري البحث ما لم تكن مدعمة بأليات قانونية حقيقية تضمن الالتزام بمقتضيات ومتطلبات الرقابة التشريعية من قبل المخاطبين بأحكام القانون كافة، وارتباطا بذلك فقد اتجهت العديد من الدول إلى إيجاد إطار مؤسسي يضطلع بمهمة حماية حرية المنافسة والتصدي للممارسات الاحتكارية، من خلال إنشاء أجهزة إدارية فنية تخصصية مستقلة - حسب الوضع الغالب -، تتولى وظيفة ضبط السوق التنافسية، والرقابة على عمليات التركز الاقتصادي. ونظرا لحداثة قانون المنافسة ومنع الاحتكار في العراق أولا، والقصور التشريعي الواضح الذي شاب نصوص القانون المذكور فيما يتعلق بالأحكام الخاصة بمجلس شؤون المنافسة ومنع الاحتكار التي ورد النص عليها في الفصل الثاني من القانون (المواد ٤-٨)، فقد ارتأينا أن نتناول في هذا البحث الإطار المؤسسي للرقابة على التركزات الاقتصادية، بتقسيمه على مطلبين، نبين في الأول آلية تكوين الجهاز المختص بالمنافسة ومنع الاحتكار، ونخصص الثاني للبحث في اختصاصات الجهاز المختص بالمنافسة ومنع الاحتكار، معتمدين منهج الدراسة القانونية المقارنة بين القانون الفرنسي والمصري والإماراتي والعراقي.
|b Despite the importance of the legal regulation of the procedures for the monitoring of the economic concentration operations by the legislator in different countries, the efforts made in this regard remain within their purely theoretical framework unless they are supported by genuine legal mechanisms that ensure compliance with necessities and requirements of the legislative oversight by all intended parties of the law, In connection with this, many countries have tended to create an institutional framework that carries out the task of protecting freedom of competition and confronting monopolistic practices, by establishing independent specialised technical administrative agencies - according to the prevailing circumstance - that assume the function of controlling the competitive market, and monitoring economic operations. Due to modernity of the competition law and the prevention of monopoly in Iraq firstly, and the apparent legislative shortcomings that marred the provisions of the aforementioned law regarding the special provisions of the council for competition affairs and prevention of monopoly that were stipulated in Chapter Two of the Law (Articles 4-8), we decided to discuss in this research the institutional framework for monitoring economic concentrations, by dividing it into two sections, In the first, we explain the mechanism for establishing the agency concerned with competition and preventing monopoly, and we devote the second to researching the specialities of this agency, adopting the approach of comparative legal study between French, Egyptian and Emirati law and Iraqi law.
