تعد ظاهرة اللجوء من الظواهر الإنسانية القديمة الموغلة في عمق التاريخ، حيث عرفت هذه الظاهرة من خلال التدفقات البشرية الجماعية كانت أو الفردية والتي كان يقوم بها الأفراد -بسبب هروبهم إلى مكان آخر، بسبب الجوع أو الخوف أو الاعتداء، والبحث عن مكان آخر آمن. اختلفت التشريعات الدولية وتباينت حول بيان مفهوم اللاجئين، حيث لم تستقر على مفهوم موحد للاجئين، كما تعد قضية اللاجئين من قبيل المشكلات ذات الطبيعة الدولية العامة التي تتعدد جوانبها على كافة المستويات السياسية والاجتماعية والاقتصادية وغيرها، وعلى ذلك فإن أي جهد تبذله المؤسسات والمنظمات الدولية العاملة في مجال رعاية اللاجئين، بكونها أحد الآليات الدولية التي تساهم في حماية حقوق اللاجئين، لن يكتب له النجاح في مواجهة تلك الظاهرة متعددة الأبعاد، وعلى ذلك يتعين تضافر جهود المجتمع الدولي قاطبة بهدف السعي نحو الوصول إلى حلول لتلك المشكلات، وكذلك تقديم أنواع من الرعاية والدعم لحقوق اللاجئين، وسد مختلف المعوقات في شتي المجالات الإنسانية والاقتصادية والاجتماعية والصحية للاجئين، وبخاصة أنه لا يمكن إجبار الدول على الموافقة على تلك الاتفاقيات. ولذلك فأن المجتمع الدولي بحاجة لمراجعة كافة الآليات الدولية الحالية والخاصة بالحماية الدولية لمشكلة اللجوء.
