المستخلص: بيد أن منظمات المجتمع المدني هي الأساس التنموي الذي تستند إليه الحكومات في تحقيق التنمية المستدامة، وهي الأساس الذي ارتضاها المجتمع في تعزيز البناء الديمقراطية وتنفيذ الرقابة وتحقيق الشفافية، ذلك أن كل فرد في المجتمع يستفيد من العيش في أمن واستقرار من اجل تحقيق تطلعاته وآماله وتنفيذ التنمية في كافة القطاعات المختلفة. بيد أن الاهتمام بمنظمات المجتمع المدني ومشاركتهم في الاستراتيجيات والبرامج التنموية التي تهدف إلى تحقيق التنمية المستدامة من أجل خلق مجال تنافسي وفتح آفاق جديدة للاستثمار وتنفيذ السياسات العامة وتحقيق التنمية، فلذلك يجب القضاء على كافة المعوقات والعقبات التي تتسبب في استبعاد وعزوف منظمات المجتمع المدني عن المشاركة في العملية التنموية. لذا يجب أن يهتم المشرع بوضع استراتيجية تشريعية وبيان كافة أبعادها لما لها من دور هام في تقدم الأمة وإلغاء العراقيل التي تواجه الديمقراطية لتحقيق التنمية والقضاء على الفساد. فلا شك أن الضمانات الوضعية لا يمكن أن تصل بذاتها إلى حماية ناجحة لتطبيق الدستور والقانون، إذ لوحظ أنه كلما اقتربنا من مواجهة السلطات الأعلى في الدولة أضحت الضمانات القانونية للأفراد ومنظمات المجتمع المدني قبلها أقل تأكيدا. ذلك أن من أهم الضمانات لتحقيق التنمية المستدامة والتحول الرقمي هو تحقيقها مجرده بعيدا عن الهوى وتحويلها من مجرد نص إلى واقع ملموس، فضلا عن توفير كافة الضمانات الاقتصادية والثقافية والسياسية والاجتماعية ملائمة للأفراد والمجتمع.

However, civil society organizations are the developmental basis on which governments rely in achieving sustainable development, and it is the basis that society has accepted in strengthening democratic construction, implementing oversight and achieving transparency, because every individual in society benefits from living in security and stability in order to achieve his aspirations and hopes and implement development In all different sectors. Especially since the interest in civil society organizations and their participation in development strategies and programs that aim to achieve sustainable development in order to create a competitive field and open new horizons for investment, implement public policies and achieve development. Therefore, all obstacles and obstacles that cause the exclusion and reluctance of civil society organizations to participate in developmental process. Therefore, the legislator should be interested in developing a legislative strategy and explaining all its dimensions because of their important role in the progress of the nation and the elimination of obstacles facing democracy in order to achieve development and eliminate corruption. There is no doubt that the positive guarantees cannot by themselves reach a successful protection for the application of the constitution and the law, as it has been observed that the closer we are to confronting the higher authorities in the state, the less certain the legal guarantees for individuals and civil society organizations before them. This is because one of the most important guarantees for achieving sustainable development and digital transformation is to achieve it abstract away from fancy and transform it from a mere text into a tangible reality, as well as providing all economic, cultural, political and social guarantees suitable for individuals and society.
