The International criminal courts exercise a range of functions of legal importance. Indeed, in parallel with their judicial functions, which consist in telling the law in the face of the most serious crimes, in pronouncing the penalties which are commensurable to them. The international criminal courts are also vested with other political functions focused on pacification, reconciliation and the promotion of the rule of law. The objective of this article will be limited to taking stock of the functional metamorphoses experienced by international criminal courts, without however addressing the evaluation of their real contribution to the realization of these new functions. Les juridictions internationales pénales exercent un éventail de fonctions d’importance juridique. En effet, parallèlement à leurs fonctions judiciaires, qui consiste à dire le droit face aux crimes les plus graves, à prononcer les peines qui leur sont commensurables, les juridictions internationales pénales sont investies aussi à remplir d’autres fonctions d’ordre politique axées sur la pacification, la réconciliation et la promotion de l’état de droit. L’objectif de cet article se limitera à faire le point sur les métamorphoses fonctionnelles qu’ont connues les juridictions internationales pénales, sans pour autant aborder l’évaluation de leur apport réel à la réalisation de ces nouvelles fonctions. |
