|a تسعى دولة الاحتلال الإسرائيلي إلى غل يد المحكمة الجنائية الدولية عن ملاحقة ومقاضاة المتهمين الإسرائيليين بارتكاب أخطر الجرائم الدولية الواردة في المادة (5) من النظام الأساسي لهذه المحكمة، وذلك بتشكيل لجان تحقيق من ضباط الجيش الإسرائيلي؛ باعتبار أن أولوية الاختصاص للقضاء الإسرائيلي على القضاء الجنائي الدولي. واتبع الباحث في هذا البحث المنهج الوصفي التحليلي وتوصلت إلى أن التشريعات الإسرائيلية تخلو من النص على الجرائم الدولية الخطيرة، ولذلك فإن عمل لجان التحقيق مخالف لمبدأ الشرعية الجنائية الدولية، ناهيك عن أن هذه اللجان تفتقد إلى المعاير الدولية للنزاهة والحيادية والاستقلالية. ومن أهم التوصيات التي وردت في هذا البحث دعوة وزارة العدل الفلسطينية والمؤسسات الحقوقية إلى إثبات عدم جدية لجان التحقيق الإسرائيلية وعدم شرعية ما يصدر عن القضاء الإسرائيلي من أحكام، ويوصي الباحث دولة فلسطين بالتوجه نحو إعادة إحالة القضايا التي نظرتها لجان التحقيق الإسرائيلية وصدر فيها أحكام من القضاء الإسرائيلي إلى المحكمة الجنائية الدولية.
|b The Israeli occupation State seeks To hamper the work of International Criminal Court in the prosecution and adjudication of the Israeli charged with the most serious international crimes contained in article 5 of the Statute of the Court, by forming investigative committees of the Israeli army officers, considering the supremacy of the Israeli jurisdictions over the international criminal justice. I have adopted the descriptive analytical approach in conducting this research and concluded that the Israeli legislations are devoid of any provisions for serious international crimes. Thus, the work of the investigation committees acts contrary to the principle of the international criminal jurisdiction, not to mention that these committees lacked the international standards of impartiality, neutrality, and independency. One of the most important recommendations contained in this research is calling upon the Palestinian Ministry of Justice and Human rights organizations to prove the absence of serious of the Israeli investigation committees and the illegality of the Israeli judiciary of what it makes of provisions. We recommend Palestine state to trend towards referring the issues heard by the Israeli investigation committees and the judgements passed by the Israeli judiciary back to the international criminal court.
