المستخلص: لم يقتصر الخطاب التكليفي على بيان أحكام ومعاني النصوص الفقهية بالاعتماد على ظاهرها، بل تعداه إلى التأويل والتفسير المستند إلى الدليل من الكتاب، والسنة، والإجماع والقياس، والقواعد الفقهية، والحكمة التشريعية، وكان الهدف من التأويل بيان وإظهار مراد الشارع ومقصودة فيه، وتنزيل النص الفقهي على الواقع حسب ظروف الزمان، والمكان والأحوال، وهذا بحث مختصر موجز أسميته "التأويل وأثره في الاختلاف الفقهي" يعتمد المنهج التحليلي الاستنباطي، من الكتاب والسنة، وأقوال العلماء، يتضمن مبحثين، كل مبحث فيه خمسة مطالب، في المبحث الأول تعريف لتأويل لغة، واصطلاحا عند السلف، وعند المتكلمين والأصوليين، والمحدثين، والنحاة، والبيانيين، وكذا حكم التأويل، وأقسامه وضوابطه، وخصائصه وأنواعه، وفي المبحث الثاني بحثت في تطبيقات على التأويلات الصحيحة والمقبولة، وتطبيقات على التأويلات البعيدة والضعيفة، ومذاهب العلماء في تأويل النصوص الشرعية المتعلقة بالعقائد، ومذاهب العلماء في تأويل النصوص الشرعية المتعلقة بالأحكام الفقهية، وأخيرا درست مثالا على الاختلاف الفقهي الناتج عن التأويل، وختمت البحث بخاتمة تحوي أهم استنتاجات البحث.

The aim of the interpretation was to clarify and clarify the meaning of the Shar’i and his intention in it And download the doctrinal text on the reality according to the circumstances of time, place and conditions This is a brief, concise research called "The Interpretation and its Impact on Jurisprudential Difference" It adopts the deductive analytical method, from the Qur’an and the Sunnah, and the sayings of scholars. It includes two sections, each of which has five demands. In the first topic, a definition of interpretation of language and terminology according to the predecessors, the theologians, the fundamentalists, the modernists, grammarians, and the grammarians, as well as the rule of interpretation, its divisions, controls, characteristics and types. In the second topic, we discuss applications to correct and acceptable interpretations, and applications to distant and weak interpretations, the doctrines of scholars in the interpretation of legal texts related to beliefs, and the doctrines of scholars in the interpretation of legal texts related to jurisprudence provisions, and finally we study an example of the jurisprudential difference resulting from interpretation, and we conclude the research with a conclusion containing The most important conclusions of the research.
