المستخلص: يدور البحث حول النقد والتقييم الفقهي للحرية في النظرية الديمقراطية الليبرالية هل هي مطلقه ليس لها حدود. وهل الشخص قادر على صنع ماهيته حسب إرادته الحرة، دون أن تكون هناك أمور خارجية أو هناك قوة مؤثرة على حريته حسب قول بعض الليبراليين. بينما ينظر الإسلام في حرية الإنسان قائمة على مبدأ الشرع والقانون والإخضاع لهما بشكل يتلائم وينسجم مع (الفطرة) التي فطره الله عليها، وهذه الفطرة تقبل ما كان يلائم التركيبة النفسية والجسدية لكل البشر وتنسجم مع القيم للفرد والأسرة والمجتمع، فهي مبنية على مفاهيم كلية وشموليه قادرة على تحقيق المصالح والمنافع للفرد والمجتمع في أن واحد، بجزئياتها من دون صراع بين النفس والعقل وتحث على التمسك بالعقل بتحرير الذات الإنسانية من أي خضوع لغير الله، ورفع الإنسان عن أن يكون مطية الهوى والأمل الزائف وتقييدها ضمن القوالب الصحيحة والأفكار النظيفة. وهذا ما لا نجده في الحرية وفق المفهوم الغربي التي تقوم بصنع القوانين والتشريعات والدساتير والأعراف والثقافة بشكل وضعي، لأنه من صنع البشر القاصر بالإحاطة الشاملة في تحقيق جميع المصالح والمنافع لعموم الفرد والمجتمع بصورة عادلة لاعتماده على مفاهيم جزئية متغيرة بقوانينها الوضعية بين الحين والأخر وفق تغير الزمان والمكان، وملاحظة ذلك في الجانب العملي التطبيقي لهذه القوانين وقصورها في تحقيق العدالة والمصلحة الفردية والمجتمعية، من دون تقاطع التي تكون نتائجها الفوضى المطلقة.

While Islam considers the freedom of man based on the principle of law and law and subjecting them in a way that is consistent with (nature) on which God has innate, this nature accepts what was appropriate for the psychological and physical composition of all human beings and is with the values of the individual, family and society, it is based on holistic and comprehensive concepts capable of achieving the interests and benefits of the individual and society at the same time in its parts without conflict between the soul and mind and urges to adhere to the mind to free the human self from any submission to other God, and raise Man is about being the ride of fancy and false hope and restricting it within the right stereotypes and clean ideas. This is not found in freedom according to the Western concept, which makes laws, legislation, constitutions, customs and culture in a positive way because it is the work of minor human beings to be comprehensively informed in the realization of all interests and benefits to the general individual and society fairly because it depends on partial concepts changed by its positive laws from time to time and place and observed in the practical practical aspect of these laws and their failure to achieve justice and individual and community interest without intersection, the results of which are absolute chaos.
