|a تختلف أموال العتبات المقدسة من حيث المصدر لهذه الأموال، وقد أوضحت المادة (١٧) من قانون إدارة العتبات المقدسة والمزارات الشيعية الشريفة رقم (١٩) لسنة ٢٠٠٥ تلك الأموال، وإن استثمار تلك الأموال في المجالات الصناعية والزراعية والتجارية وتطوير وإعمار بنيات العتبات المقدسة والمزارات الشريفة، تختلف باختلاف مصدر المال من حيث نوع الوقف وكيفية شروط الواقف وصلاحية متولي العتبة والمزار في استثمار ذلك المال. فبعض تلك الأموال تعطي مساحة أو حرية لمتولي العتبة أو المزار في كيفية التصرف بذلك المال، خاصة إذا قدمت الهدايا أو النذور بدون شروط معينة وأطلق الواهب أو الناذر يد المتولي في كيفية التصرف بذلك المال، وإن شمل ذلك الإطلاق المال الموصي به أو الموقوف على العتبة أو المزار. أما إذا لم يطلق الواهب يد المتولي في كيفية التصرف بالمال ولم يحدد بشكل واضح شروط الهبة أو الوقف أو الوصية، فهنا لا بد من الرجوع إلى الحاكم الشرعي (المرجع الديني الأعلى)، والحصول على إذن أو استفتاء في كيفية التصرف بتلك الأموال، وكل ذلك يؤثر في طبيعة ونوع ومدة الاستثمار، وقد حاولنا في هذا البحث إرجاع كل مال إلى أصله وكيفية التصرف به من الناحية الشرعية والقانونية.

Some of those funds give space or freedom to the custodian of the shrine or shrine in how to dispose of that money, especially if gifts or vows are given without certain conditions and the donor or vow releases the hand of the custodian in how to dispose of that money, even if that release includes the bequeathed or endowed money on the threshold or The shrine. But if the donor does not release the hand of the trustee in how to dispose of the money and does not clearly specify the conditions of the gift, endowment or will, then here it is necessary to refer to the legal ruler (the highest religious authority), and obtain permission or a referendum on how to dispose of those funds, and all of this affects In the nature, type and duration of investment, we have tried in this research to return every money to its origin and how to dispose of it in terms of legitimacy and legality.
