المستخلص: تتفق أغلب دساتير الديمقراطية الحديثة على تبني مبدأ الفصل بين السلطات عبر بيان حدود ووظيفة كل سلطة من سلطات الدولة، وعلى هذا يفرد للدستور نصوصا تبين حدود كل سلطة وتبين كيفية تنفيذها وعلاقاتها بالسلطات الأخرى وبما لا يقبل التفويض في تلك الاختصاص، ومن المسلم به أن السلطة التشريعية في الدول الديمقراطية غالبا ما تتكون من مجلس واحد أو مجلسين بحسب نظام تلك الدول، ومن بين الاختصاصات التي يقوم فيها البرلمان في أغلب الدول الديمقراطية الاختصاص التأسيسي بمساهمة في وضع القانون الأسمى في الدولة ألا وهو الدستور عن طريق اقتراح مسودته بوصفه وكيلا أو نائبا عن الشعب، زيادة على مناقشة التعديلات الدستورية وإقرارها وفقا للطرق المرسومة في الدستور وصولا إلى تحقيق مبدأ الديمقراطية في ممارسة السلطة، وتتجلى أهمية البحث في بيان أثر البرلمان في مجال اقتراح أو وضع المسودة الدستورية ثم دراستها في البرلمان والتصويت عليها قبل طرحها على الشعب في استفتاء دستوري عام لأخذ موافقة الشعب على ذلك الدستور، وقد استخدمنا في بحثنا المنهج التحليلي المقارن بين دستور جمهورية العراق لسنة 2005 ودستور الجمهورية الخامسة الفرنسي لسنة 1958 المعدل، وتوصلنا إلى الأثر الذي يؤديه البرلمان في الدستورين العراقي والفرنسي في وضع الدستور والموافقة عليه، مستنتجين من ذلك أن الأثر الذي يؤديه البرلمان العراقي في عملية الوضع والموافقة على الدستور أكثر من أثر البرلمان الفرنسي؛ لأن السلطة التنفيذية في فرنسا بيد رئيس الدولة يفوق أثر البرلمان، وعبر بحثنا نوصي بإشراك الشعب في عملية إعداد مسودة الدستور.

The majority of modern democracy constitutions agree on adopting the standards of separation of powers by defining the limits and the function of each sake holder from the state’s authorities. Among the competencies that parliament in most democratic countries has is the founding jurisdiction through its contribution to the development of the supreme law in the state, which is the constitution by proposing its draft as an agent or deputy On behalf of the people, in addition to discussing and approving the constitutional amendments in accordance with the methods laid down in the constitution in order to achieve the principle of democracy in power practices. A general constitutional referendum in order to obtain people approval that constitution, we have used in our research the comparative analytical method between both the Iraqi constitution of 2005 and the French Constitution 8521, with strengthening of research with some constitutional systems supporting the subject of our project, And we reached the role that the parliament plays in both Iraq and France in drafting and approving the constitution, deducing from this that the role played by the Iraqi parliament in the process of establishing and approving the constitution is more than the role of the French parliament, since the executive authority in France is in the hands of the head of state that outweighs the role of parliament Through our research, we recommend that the people be involved in the process of preparing the draft constitution.
