المستخلص: من رحمة الله- تعالى- ولطفه، أن أحكام الشريعة من أوامر إنما كانت بما ينفعهم ويوصلهم إلى سعادتهم، ويبلغهم الكمال، كما أن النواهي إنما كانت مما يضرهم. ويحط من قدرهم، ويبعدهم عن سعادتهم. ولما كانت أعطاب الأعضاء البشرية لها أثر في تباين آراء الفقهاء في الأحكام، فقد آثرت أن أدلي بدلوي في هذا الشأن ببيان الأحكام المتعلقة بها، لما له من القيمة والأثر في إظهار وبيان مدى سماحة شريعتنا الغراء، لأجل هذا فقد شعرت بارتياح نفسي للكتابة في هذا البحث المعنون بـ الأحكام الفقهية لأعطاب الأعضاء البشرية في العبادات (الوجه والرأس أنموذجا) وبين يدي هذا البحث كثير من الآراء الفقهية والأحكام المتعلقة بالخلل في الوجه والرأس، والتي إن دلت على شيء فإنما تدل على كمال الشريعة وبيان مدي شموليتها بوجود العديد من التطبيقات المختلفة لها في الأبواب الفقهية عموما، وفي أبواب العبادات خصوصا، وهذا كله يصب في بيان أن هذه الشريعة من عند الله حقا، وأنها الخاتمة للرسالات كلها، وأن الإنسان مخلوق مكرم بتكريم الله له، قال تعالى: "وَلَقَدْ كَرَّمْنَا بَنِي آَدَمَ" (من الآية ۷۰: سورة الإسراء). وفيه أيضا بيان لما وضعته الشريعة من قواعد عامة للأمور التي تتغير بتغير الأحوال والأزمان والأماكن والأعراف، وأطلقت للعقل مجال الاجتهاد والبحث، وحثها عليه في أحكام المسائل التي لم تنص عليها نصا قطعيا، ورتبت على ذلك أن للمصيب أجرين وللمخطئ أجرا. كل هذا تعرضت لبيانه في هذا البحث بصياغة جديدة تحافظ على الثوابت في شريعتنا الغراء مع المواكبة لمقتضيات العصر ولغته، بحيث يجمع بين أصالة القديم وبريق الجديد، قاصدا بذلك- إن شاء الله- الوصول إلى الحق، واقفا مع اتجاه من بعضده ويقويه الدليل، والله يقول الحق وهو يهدي السبيل.

From the mercy and kindness of God Almighty, the rulings of the Shari’a were commands that benefit them, lead them to their happiness, and reach them perfection, just as the prohibitions were only that which harms them, degrades their status, and distances them from their happiness. And since the defects of the human organs have an impact on the differing opinions of the jurists in the rulings, I chose to give my opinion in this regard by explaining the rulings related to it, because of its value and impact in showing and explaining the extent of the tolerance of our noble Sharia. entitled Fiqh rulings for defects in human organs in worship (face and head as a model) In the hands of this research are many jurisprudential opinions and rulings related to defects in the face and head, which if they indicate anything, they indicate the perfection of the Sharia and the extent of its comprehensiveness, with the presence of many different applications of it in the jurisprudence chapters in general, and in the chapters of worship in particular, and all this serves to indicate that This law is truly from God, and it is the conclusion of all messages, and that man is an honorable creature with God’s honoring of him, the Almighty said: “And We have honored the children of Adam.” (From verse 70: Surat Al-Isra). It also includes a statement of the general rules laid down by Sharia for matters that change with the change of conditions, times, places and customs, and it freed the mind in the field of ijtihad and research, and urged it to do so in the rulings of issues that were not specifically stipulated in a text, and it was arranged that the rightful person has two rewards and the wrong one has a reward. All this was explained in this research with a new formulation that preserves the constants in our noble Sharia, while keeping pace with the requirements and language of the era, so that it combines the originality of the old and the luster of the new, intending by this- God willing- to reach the truth, standing with the direction of those who support it and strengthen it evidence, and God He says the truth and he guides the way.
