المستخلص: تبرز أهمية موضوع البحث في كون حماية الأصول الموقوفة معلما أساسيا في فقه الوقف، فمصلحة الوقف يراعى فيها: مصلحة الموقوف، ومصلحة الموقوف عليه، والتزام شروط الواقف، وذلك لا يتحقق إلا برعاية أصل الوقف حفظا ونماء. وبناء على ذلك ومع انتشار ظاهرة الاستيلاء على الأوقاف، وتدني هيبة هذا المفهوم في نفوس شرائح من الناس على خلاف المعهود قديما- تبقى الحاجة داعية- وبقوة- إلى التأصيل لقضية حماية الأوقاف من الاعتداءات وبيان سبلها ومنطلقاتها،، عن طريق النظر الشرعي الفقهي أولا، ثم عن طريق التأصيل للأدوات الإدارية المؤثرة في الأمر، عسى أن يترجم هذا التأصيل عند من يلمس الحاجة إليه إلى نظرية إدارية وقانونية خاصة بمجال الوقف، تفضي إلى حمايته والحفاظ عليه إجرائيا وبشكل عملي. وقد عمل الباحث- ما وسعه الجهد- على ملامسة موضوع: «سبل حماية الأصول الوقفية سواء أكانت الأدوات مباشرة أم غير مباشرة، ليتحقق النفع الأكبر للموقوف عليه، فضلا عن تحقيق المصلحة العامة في وجود الوقف واستمرار نفعه جيلا بعد جيل، ولن يحقق الوقف مقاصده إن لم نرع أصوله خير رعاية.

The importance of the research topic is highlighted in the fact that the protection of waqf assets is an essential milestone in Waqf jurisprudence. The interest of the Waqf considers: The interest of Waqf asset, and the beneficiary, and commitment to Waqf conditions, which is achieved only by preserving Waqf assets in preservation and augmentation. Consequently, as the phenomenon of grabbing Awqaf spreads, and this concept reverence declines for some categories of people contrary to the old tradition, there is a strong need to root for the issue of protecting Awqaf from attacks and to clarify their means and perspectives, through legal and jurisprudential consideration at first, and then by rooting for the administrative instruments influencing the matter. Perhaps it is interpreted for whom see the need of it into an administrative and legal theory specific to the field of Waqf, which results in its protection and preserving it procedurally and practically. The researcher worked with every effort to perceive the topic: «Methods of Protecting Waqf Assets», whether by direct or indirect instruments, in order to achieve the greatest benefit for the beneficiary, as well as the public interest in the existence of the waqf and its continued usefulness for generation after generation. The waqf will not achieve its purposes if its assets are not well preserved.
