المستخلص: أصبح الحاسب الآلي في مصر يحل محل الإنسان في كثير من المجالات كما هو الحال في الدول المتقدمة في معظم مرافق الدولة، وأصبحت هذه المرافق في الوقت الحالي تدار بنظام – الحكومة الإلكترونية- (الحاسبات الآلية) بدلا من إدارتها بالطرق التقليدية وما تنسم به من بطء في الإجراءات – وزيادة النفقات ومشكلات الأداء، وذلك بشرط أن تطوع وتفسر المبادئ العامة التي تحكم سير المرافق العامة حتى تتوافق مع نظام الإدارة الإلكترونية. وعندما تقوم جهة الإدارة بإشباع الحاجات العامة للجمهور من خلال المرافق العامة- التي تقدم هذه الخدمات، فإنها تمتع ببعض امتيازات السلطة العامة، فضلا عن السلطة التقديرية التي تمنح لها من قبل القانون، للقيام بدورها المنوط بها – وقد تقيد هذه السلطة في أحيان كثيرة – الأمر الذي يخولها الحق في فرض إراداتها على الأفراد إلزامهم بها، مثل سلطة الإدارة في إصدار القرارات الإدارية وغيرها من التصرفات. ولا شك أن مسئولية الإدارة والتي تقوم على أساس ركن الضرر والعلاقة السببية بين الفعل والضرر دون حاجة لوجود خطا تشكل مجالا رحبا يمكن الاستناد إليه بالتعويض عن أضرار الحاسبات الآلية، ومن ثم أصبح الاعتراف بالمسئولية دون توافر ركن الخطأ علي قدر كبير من الأهمية في هذا المجال.

The computer in Egypt has replaced the human being in many areas, as is the case in developed countries in most of the state’s facilities, and these facilities are now managed by the e-government system (computers) instead of managing them using traditional methods and the slowness in the process. Procedures- increasing expenses and performance problems, provided that you volunteer and explain the general principles that govern the functioning of public utilities in order to comply with the electronic management system. And when the administration satisfies the general needs of the public through public utilities- which provide these services, it enjoys some of the privileges of the public authority, in addition to the discretionary power granted to it by the law, to perform its role entrusted to it- and this authority may restrict in many cases- the matter Which gives it the right to impose its will on individuals to oblige them, such as the authority of the administration to issue administrative decisions and other actions. There is no doubt that the responsibility of the administration, which is based on the element of damage and the causal relationship between the act and the damage without the need for the existence of a mistake, constitutes a wide field that can be relied upon to compensate for computer damage, and then the recognition of responsibility without the availability of the error element has become of great importance in this field.
