المستخلص: راعت الشريعة الغراء إنسانية الإنسان بالأحكام الحكيمة العادلة المناسبة له قبل الولادة وبعدها، كما يتجلى لنا التكريم الإلهي للإنسان في جميع شؤون الحياة وأطوار الإنسان؛ ليكون المكرم عند الله، والخليفة في الأرض، ولصون هذه الكرامة نهى الشارع عن التذلل وإظهار الضعف واستدعاء الوهن، فمن مظاهر ذلك شيوع التسول الإلكتروني في الفضاء الرقمي كأداة لتحقيق أهداف غير مشروعة عبر وسائل تقنية المعلومات ومنصات التواصل الاجتماعي بهدف استعطاف المستخدمين للحصول على المنافع المادية والعينية بإرسال رسائل نصية، وصور إنسانية مفبركة، ووثائق مزورة، ومعلومات مغلوطة، وعليه ينبغي التصدي له من خلال التوعية والتدابير الوقائية؛ فإن تعذر الإصلاح لزم تدخل سلطة القضاء في فرض تشريعات إلزامية، وعليه جاءت هذه الدراسة لتتناول التسول الإلكتروني. ولخوض غمار البحث والتحليل لمفردات الدراسة وتفاصيلها كانت هيكلية الدراسة تتمثل بمقدمة وثلاثة مباحث وخاتمة بالنتائج والتوصيات، ومن أهم النتائج التي توصل إليها أن ظاهرة التسول الإلكتروني لا تختلف عن التسول التقليدي؛ فهي قائمة بالأساس على الخداع، والتحايل، والاستغلال للحصول على المنافع المادية، والعينية، كما وتعود مبررات انتشار التسول الإلكتروني إلى عوامل متعددة منها الاجتماعية، والاقتصادية، والسياسية والأخلاقية، حيث وضعت الشريعة السمحة من الضوابط والأطر العامة التي تبين أهمية السعي إلى العمل المشروع، وحذرت من الكسب غير المشروع وشددت في خطاب النهي عن العمل غير المشروع. ويتجلى مدى التوافق بين الشريعة الإسلامية والتشريع الإماراتي في محاربة التسول الإلكتروني، من جوانب إيمانية وعلمية، وجوانب تشريعية ليحتكم جميع الأطراف لأحكام واضحة محددة العقوبات، والتأكيد على أهمية استثمار الوسائل التقنية والطرق التكنولوجية المتاحة للوصول لأكبر شريحة من أفراد المجتمع ومخاطبة الأجيال وخاصة النشء بصورة ذكية تتناسب مع ميولهم وواقعهم. ويوصى بضرورة تكاتف الجهود، سواء من قبل الجهات المختصة، وحتى شتى شرائح المجتمع للحد من التسول الإلكتروني، ويأتي ذلك أيضا من خلال إطلاق حملات التوعية والحرص على التسلح بالوعي المجتمعي لذلك، وتغليظ العقوبات وفق الجرم الجنائي المترتب على التسول الإلكتروني ودوافعه، ونشر هذه العقوبات وتعميمها على أفراد المجتمع سدا لذريعة انتشارها، وتحويل هذه العقوبات لحيز التنفيذ.

The gracious Sharia considered the humanity of man with the wise and just rulings appropriate to him before and after birth, just as the divine honor of man is manifested in all aspects of life and human phases. To be honored by Allah and the Caliph on earth, and to preserve this dignity, the Lawgiver forbade humiliation, showing weakness and invoking weakness. By sending text messages, fake human images, forged documents, and false information, and it should be addressed through awareness and preventive measures; If reform is not possible, the judicial authority must intervene in imposing mandatory legislation, and accordingly this study came to address electronic beggary. To delve into the midst of research and analysis of the study’s vocabulary and details, the structure of the study was represented by an introduction, three sections, and a conclusion with results and recommendations. Among the most important findings he reached is that the phenomenon of electronic beggary does not differ from traditional beggary; It is based mainly on deception, fraud, and exploitation to obtain material and in-kind benefits, and the justifications for the spread of electronic begging are due to multiple factors, including social, economic, political and moral ones, where the tolerant Sharia has established general controls and frameworks that show the importance of lawful earning and the pursuit of legitimate work., and warned against graft and stressed in a letter forbidding illegal work. The extent of compatibility between Islamic Sharia and Emirati legislation in combating electronic beggary is manifested in terms of faith, science, and legislative aspects so that all parties rule for clear provisions with specific penalties, and stress the importance of investing technical means and technological methods available to reach the largest segment of society members and to address generations, especially young people, in a smart manner that suits With their tendencies and reality. It is recommended that efforts should be made, both by the competent authorities, and even by the various segments of society, to reduce electronic beggary, and this also comes through launching awareness campaigns and keenness to arm with societal awareness of this, and to intensify the penalties according to the criminal offense resulting from electronic beggary and its motives, and the dissemination and circulation of these penalties The members of the community must block the pretext of its spread, and transfer these penalties into effect.
