المستخلص: يتحدث هذا البحث عن حقوق الإنسان وهي تولد مع الفرد ولصيقة به، وهذه الحقوق لا يمكن التنازل عنها أو المساس بها تحت أي ظرف من الظروف وهي أساسيات في حياة الفرد أينما كان على وجه الأرض، ومشكلة حقوق الإنسان ترجع إلى غياب النظام الكفيل باحترامها الفعلي على المستويين الدولي والداخلي. وتم تعريف حقوق الإنسان، ثم بيان خصائص هذه الحقوق، وتتميز حقوق الإنسان عن غيرها من الحقوق الأخرى بعدة خصائص فهي لها طبيعة خاصة لا توجد في باقي الحقوق، ومنها أنها ذات طابع عالمي ونسبيتها وكذلك أنها حقوق مترابطة ومتكاملة. ثم بيان حقوق الإنسان في مصر ومدي تطورها واهتمام الدولة باحترامها، ومن ذلك أنها أدرجتها في كل الدساتير القديمة والحديثة التي صدرت في مصر، واهتمت بحمايتها ووضع الضوابط لها والرقابة الكفيلة بحمايتها، ثم بيان الاتفاقيات الدولية والإقليمية الخاصة بحقوق الإنسان والتي انضمت لها مصر ونفذتها وطبقتها كقوانين داخلية في الدولة. ثم تم تعريف وأهمية حالة الطوارئ وأنها حالة استثنائية وليست حالة طبيعية تلجأ إليها الدول وتفرضها في ظروف استثنائية ألمت بالدولة ولا تصلح القوانين العادية في مواجهة هذه الظروف. ثم تم توضيح ما هو أثر فرض حالة الطوارئ على الحقوق والحريات، وأنها تؤثر وتقيد بعض الحقوق والحريات بشكل معين، ثم تم توضيح آليات وضمان حماية الحقوق والحريات في ظل فرض حالة الطوارئ، وهي ضمانات دستورية، وضمانات قضائية وضمانات دولية. وقد تم تقسيم هذا البحث إلى مبحثين نقسم كل منهما إلى ثلاثة مطالب كالتالي: نخصص المبحث الأول لتعريف حقوق الإنسان، وحالة وتطور حقوق الإنسان بمصر، وكذا الاتفاقيات التي انضمت مصر لها في ذات الشأن. ونخصص المبحث الثاني لتعريف وأهمية حالة الطوارئ، وأثر فرض حالة الطوارئ على الحقوق والحريات، وكذا آليات وضمان حماية الحقوق والحريات في ظل فرض حالة الطوارئ.

This research talks about human rights as they are born with the individual and are closely related to him, these rights cannot be waived or violated under a circumstances, and they are essential in the life of the individual wherever he is on the face of the earth The problem of human rights is due to the absence of a system that guarantees their effective respect at the international and domestic levels Then we showed human rights in Egypt, the extent of their development, and the state's interest in respecting them, It included it in all the ancient and modem constitutions issued in Egypt. It was concerned with protecting it, setting controls for it, and oversight to protect it. Then, we explained the international and regional agreements on human rights to which Egypt acceded, implemented and applied as internal laws in the state Then we clarified the nature, definition, and importance of the state of emergency and that it is an exceptional case and not a natural state that countries resort to and imposes in exceptional circumstances that have affected the state and that ordinary laws are not suitable in facing these circumstances Then we explained what are the effects of imposing a state of emergency on rights and freedoms, and that it affects and restricts some rights and freedoms in a certain way Then we clarified the mechanisms and guarantees of protecting rights and freedoms under the imposition of the state of emergency, which are constitutional guarantees, judicial guarantees and international guarantees. This research has been divided into two sections, each of which is divided into three demands as follows: We dedicate the first topic to the definition of human rights and what they are, the status and development of human rights in Egypt, as well as the agreements to which Egypt has acceded in the same regard. We dedicate the second topic to the nature, definition and importance of a state of emergency, and the effects of imposing a state of emergency on rights and freedoms, as well as mechanisms and guarantees for the protection of rights and freedoms under the imposition of a state of emergency.
