المستخلص: أكرم الله أمتنا برسالة الإسلام الخالدة، وأودع شريعته السمحة بأحكام تعنى بالإنسان لقصد إسعاده، وأولت الشريعة أكبر عناية للمرأة باعتبارها الأضعف في المجتمع؛ حيث هضمت حقوقها، وبخست كرامتها قرونا، فأوصت بإكرامها أما وأختا وزوجة وبنتا، وشددت في اعتبار رضاها في شؤون حياتها الخاصة، خصوصا ما يتعلف بمستقبلها بارتباطها برفيق حياتها بعقد دائم، فأمرت باستئذانها بكرا، وباستنطاقها ثيبا، ونهت عن تعسفها زوجة، ومنع عضلها طليقة، وأحاطت الفتاة بسياج قوي لمنع تحديد مصير حياتها وهي صغيرة لا اختيار لها. ولما كانت المرأة رقيقة المشاعر، جياشة العاطفة، قد يسوء اختيارها لشريك حياتها، وهي بكل حال تحتاج لمن يحوطها ويحافظ عليها، جعلت سلطة الولاية عليها لأرحم الناس بها، وأحرصهم على مصالحها، وهم أولياؤها نسبا كالأب والجد والأخوة، ولا يتم عقد الزواج عليها إلا بموافقتهم ورضاها. وهذا البحث محاولة لبيان تلك الحدود والقيود على ولى المرأة في النكاح؛ بما يتبين معه عظمة الشريعة في التأكيد على حقوق المرأة وصون كرامتها، حتى تنعتق عن ربفة الأسر، وتتمتع بحريتها وحقوقها كاملة غير

Allah is more generous our nation's with eternal message of Islam, and deposited his tolerant law to the provisions dealing with human beings with a view to make him happy, and Sharia paid greater attention to women as she is the weaker in society; where digested her rights, and understated her dignity for centuries, it recommended to honor her whether she is a mother, sister, wife and daughter, and it stressed in regard satisfaction in her own affairs, especially with regard to her future be associated with her life companion with a permanent contract, and it ordered to have her permission if she is a virgin, and ask her if she previously married, and discouraged from arbitrariness as a wife, and prevent her of getting marriage if she is divorced, the girl took a strong fence to prevent determine the fate of her life as a small has no choice. As women are thin feelings, emotion emotions, she may worsen selected for her partner, which in all cases needs to those who fundamentally and maintain, so the guardianship authority have made by the kindest people related to her, and Keen her interests, they are their guardians proportions as the father and grandfather and brothers, and the marriage contract don not be without their consent and satisfaction. The woman's guardian is a crucial element in determining their future, and are associated with several provisions pertaining to women in her marriage, the law has given him the authority based on her interests, but some of the guardians may abuses his authority and overtake it, and perhaps abuse of women and injustice her, so the legal rulings came to made by the limits of that power, and placed restrictions upon it; so as not to derail the track, and those restrictions which refer to affections in the guardian of incompetence such as youngling, madness and loss of majority, some of which refer to congenital affections such as his bawdry, abuses or injustice, some of which refer to affections in previously married, virgin or youngling, and for each affections its limitations and legitimacy exceptions, and restrictions refer to the Act on the one hand guardian -the Government - to regulate the contracts process; including utility back on women, family and society, and limits the nature of the authority of the woman's guardian. This research is an attempt to show those limits and restrictions on the woman's guardian in the marriage; including shows the greatness of Sharia in the emphasis on women's rights and the preservation of her dignity, even frees from the neck of being captive, and enjoying her freedom and rights uncompromised, as revealed by the timeless Sharia.
