الشريعة الإسلامية عامة وباقية وصالحة للتطبيق في كل زمان ومكان، والفقه الإسلامي باعتباره فرعا من فروعها يعتبر هو العامل الأساسي الذي يسهم في بناء الفرد والمجتمع، حيث يعتبر ضربا فريدا من التشريعات والقوانين التي عرفها العالم منذ بدايته حين تاريخه وإلى قيام الساعة. ومن الأحكام التي اهتمت بها الشريعة الإسلامية ولم تتركها للأهواء والأغراض الشخصية، ما يتعلق بالمسحور من أحكام في مسألتي النكاح والطلاق، خاصة بعد انتشار السحر في الآونة الأخيرة، وتسببه في خلل كبير في بعض البيوت والأسر. وقد تناولت هذه المسألة في بحثي تحت عنوان: "أثر السحر على النكاح والطلاق دراسة فقهية مقارنة". وقمت ببيانه وتوضيحه من خلال الآتي: المبحث الأول: التعريف بمفردات البحث. ويحتوي على مطالب. المبحث الثاني: التكييف الفقهي للنكاح الصادر من مسحور. ويحتوي على مطالب. والمبحث الثالث: الآثار المترتبة على نكاح المسحور. ويحتوي على مطالب. والمبحث الرابع: التكييف الفقهي للطلاق الصادر من مسحور. ويحتوي على مطالب. وخاتمة وتحتوي على أهم النتائج والتوصيات. بهذا أكون قد انتهيت من بحثي.
Islamic Sharia is general, enduring and valid for application in every time and place, and Islamic jurisprudence, as a branch of its branches, is considered the main factor that contributes to building the individual and society, as it is considered a unique type of legislation and laws that the world has known, from its beginning until its date and until the emergence of the Hour. Among the rulings that Islamic Sharia paid attention to and did not leave it to whims and personal purposes, are the rulings related to the bewitched in the issues of marriage and divorce, especially after the spread of witchcraft in recent times, and its cause of great imbalance in some homes and families. I dealt with this issue in my research under the title: “The Effect of Magic on Marriage and Divorce: A Comparative Jurisprudential Study.” I explained and clarified it through the following: The first topic: Introducing the search terms. It contains requirements. The second topic: the jurisprudential adaptation of the marriage issued by enchanted. It contains requirements. And the third topic: the effects of the enchanted marriage. It contains requirements. And the fourth topic: the jurisprudential conditioning of divorce issued by the enchanted. It contains requirements. And a conclusion and contains the most important results and recommendations. With this, I have finished my search.
