تناول هذا المقال المركز القانون للحامل المهمل للورقة التجارية في التشريع الموريتاني والمقارن، وذلك من التعرض لكل الموضوعات ذات الصلة تأثرا وتأثيرا، وذلك من خلال التعرض لصور الإهمال، سواء تلك المتعلقة بإهمال تحرير الاحتجاج في وقته المحدد وبالأشكال القانونية المطلوبة، سواء في ذلك احتجاج عدم الوفاء أو احتجاج عدم القبول، وكذلك حالة إهمال العرض للوفاء أو القبول مع مراعاة الزمان والمكان المحددين لذلك. كما تناول هذا المقال العوامل المؤثرة في إعمال السقوط، سواء تلك الناتجة عن شرط مدرج على متن الورق التجارية نفسها، أو تلك الناتجة عن حصول قوة قاهرة، كما تم التعرض لنظام السقوط الذي يترتب على ذلك الإهمال، وذلك من خلال دراسة خصائص السقوط التي تميزه عن مختلف الأنظمة المشابهة. كما تعرضنا لنطاق ذلك السقوط من حيث الأشخاص الذين يطال السقوط حقهم من جهة، والدعوى التي تتأثر بالسقوط من جهة أخرى. وذلك ما مكن من التعرف على السقوط من خلال بعديه الموضوعي (الدعوى التي ينالها السقوط) والشخصي (الأشخاص الذين لهم الحق في التمسك بالسقوط).
