المستخلص: إن وجود الشروط التعسفية في عقود الإذعان يؤثر سلبًا على الطرف المذعن مما يجعله في حاجة إلى حماية قانونية، ولهذا تدخل المشرع الجزائري لمعالجة هذا الوضع، وذلك بمنح القاضي سلطة تعديل الشرط التعسفي الذي يتضمنه عقد الإذعان، ويعتبر هذا التعديل مجددًا للالتزام حيث يلغي الالتزام الناتج عن العقد وينشئ التزامًا جديدًا مصدره الحكم القضائي وعليه جاءت هذه الدراسة للبحث في هذا الحكم القضائي المعدل للشروط التعسفية باعتباره مصدرًا من مصادر الالتزام.

The presence of arbitrary conditions in adhesion contracts adversely affects the weak party, which makes him in need of legal protection, and for this reason the Algerian legislator has intervened to address this situation, by granting the judge the authority to amend the arbitrary condition contained in the adhesion contract, and this amendment is considered to be a renewal of the obligation as the resulting commitment cancels about the contract and establishes a new commitment from the judicial ruling, and accordingly this study came to search for this judicial ruling as a source of commitment.

La présence de conditions arbitraires dans les contrats d'adhésion nuit à la partie faible, ce qui lui confère une protection juridique, et c'est pourquoi le législateur algérien est intervenu pour remédier à cette situation, en accordant au juge le pouvoir de modifier la condition arbitraire contenu dans le contrat d'adhésion. A propos du contrat est établie une nouvelle obligation de le jugement, et en conséquence cette étude est venue chercher cet jugement comme une source d'obligation.
