المستخلص: لقد نص المشرع الدستوري على حرية التجارة والصناعة كمبدأ دستوري، وهو ما نتج عنه حرية المنافسة، وهذه الأخيرة لا تقوم إلا على أساس حرية الأسعار التي تعتبر من المبادئ الأساسية التي تقوم عليها المنافسة كأصل عام، ولكن هذا المبدأ لا يؤخذ على إطلاقه، فقد تتدخل الدولة لتحديد الأسعار تماشيا مع أوضاع معينة وباستعمال آليات محددة بموجب القانون محاربة للمضاربة وحماية للمستهلك. ولعل الهدف من هذه الورقة البحثية هو حماية القدرة الشرائية للمستهلك، وضمان استقرار السوق. ولعل التساؤل الذي يثار في هذا الصدد هو: ما مدى تدخل الدولة في عملية تحديد الأسعار؟ للإجابة عن هذا التساؤل اعتمدنا المنهج الوصفي والتحليلي مقسمين موضوع الدراسة إلى ثلاث محاور كل محور يتضمن عناصر معية

The constitutional legislator stipulated freedom of trade and industry as a constitutional principle, which resulted in freedom of competition, and the latter is based only on freedom of prices, which is one of the basic principles upon which competition is based as a general principle, but this principle is not taken to launch it, so the state may interfere To set prices in line with certain conditions and by using specific mechanisms under the law to fight speculation and protect the consumer. The aim of this research paper is to protect the purchasing power of the consumer and ensure market stability. Perhaps the question that arises in this regard is: To what extent is the state involved in the process of setting prices? To answer this question, we adopted the descriptive and analytical method, divided the subject of the study into three axes, each of which includes specific elements.

Le législateur constitutionnel a stipulé la liberté du commerce et de l'industrie comme un principe constitutionnel, qui a abouti à la liberté de la concurrence, et cette dernière est basée uniquement sur la liberté des prix, qui est l'un des principes de base sur lesquels la concurrence est fondée en tant que principe général, mais ce principe n'est pas pris pour le lancer, de sorte que l'État peut interférer Fixer des prix conformes à certaines conditions et utiliser des mécanismes spécifiques prévus par la loi pour lutter contre la spéculation et protéger le consommateur. L'objectif de ce document de recherche est de protéger le pouvoir d'achat du consommateur et d'assurer la stabilité du marché. Peut-être la question qui se pose à cet égard est: dans quelle mesure l'État est-il impliqué dans le processus de fixation des prix? Pour répondre à cette question, nous avons adopté la méthode descriptive et analytique, divisé le sujet de l'étude en trois axes, chacun comprenant des éléments spécifiques.
