المستخلص: تناول الباحث في هذا البحث عن الاجتهاد في الشريعة الإسلامية، مفهومه ومشروعيته وأركانه، وشروطه، وأقسامه في الشريعة الإسلامية، وحكم الاجتهاد من حيث الوجوب والندب وكراهة والتحريم، وبيان حكمه من حيث الخطأ والصواب. ومشروعية الاجتهاد من القرآن والسنة والإجماع، ونماذج من التصرفات النبي صلى الله عليه وسلم العام والخاص، والفرق بين تصرفاته التشريعية والعادية. واختلاف الفقهاء والأصوليين حول وقوع الاجتهاد من النبي صلى الله عليه وسلم وتحرير محل النزاع والإجماع في المسألة، مع بيان قول الراجح في المسألة، وفقا للأدلة والوقائع التي ثبت بالقرآن والسنة أنه صلى الله عليه وسلم قد اجتهد وعمل باجتهاده. وذكر الباحث أمثلة على وقوع الاجتهاد من النبي صلى الله عليه وسلم، وتصرفاته النبي صلى الله عليه وسلم نوعان منها ما هو وحي، وما هو ليس وحي، مما يجعل الشريعة الإسلامية صالح لكل زمان ومكان ومواكب تطورات العصر الحديث.

In this research, the researcher dealt with jihad in Islamic law, its concept, its legitimacy, its pillars, its conditions, and its divisions in Islamic law, and the ruling on jihad in terms of obligation, recommendation, dislike and prohibition, and the statement of its ruling in terms of right and wrong. And the legitimacy of jihad from the Qur’an, Sunnah and consensus, and examples of the Prophet’s actions, both public and private, and the difference between his legislative and ordinary actions The difference of jurists and fundamentalists about the occurrence of jihad from the Prophet, may God’s prayers and peace be upon him, and the liberation of the subject of dispute and consensus on the issue, with an explanation of the most correct opinion on the issue, according to the evidence and facts that are proven by the Qur’an and Sunnah that he, may God’s prayers and peace be upon him, worked hard and acted according to his jihad. The researcher mentioned examples of the occurrence of diligence from the Prophet, may God’s prayers and peace be upon him, and his actions of the Prophet, may God’s prayers and peace be upon him, are of two types: what is revelation, and what is not revelation, which makes Islamic Sharia valid for every time and place and the developments of the modern era.
