|a تتضمن هذه الرسالة دراسة صيغ الأمر والنهي غير الصريحة عند الأصوليين، دراسة تطبيقية في فهم هذه الصيغ من النصوص الشرعية، وذلك بالنظر في كتب أصول الفقه في هذه الصيغ، ومعرفة دلالتها في النصوص الشرعية. والرجوع إلى كتب التفسير وشروح السنة واللغة العربية للتأكد من هذه الصيغ ومعرفة معانيها. ثم مناقشة تلك الصيغ والدلالات بأمثلة من الكتاب والسنة النبوية، ومن خلال الحديث عن الصيغ استنبطت بعض الضوابط لمعرفة صيغ الأمر والنهي غير الصريحة، ومعرفة أهمية هذه الصيغ وأسباب الإتيان بها في النصوص الشرعية. مع معرفة أسباب ندرة هذا الموضوع عند المتقدمين من الأصوليين، قسم هذا العمل إلى تمهيد ومبحثين، يندرج تحت المبحث الأول صيغ الأمر غير الصريحة. أما المبحث الثاني فكان في صيغ النهي غير الصريحة. ثم عرضت أهم النتائج التي توصل إليها من خلال هذا العمل، وفي نهاية البحث كانت هناك توصيات إلى ضرورة الاعتناء بصيغ الأمر والنهي غير الصريحة، وعمل بحوث مطولة ومفصلة حول هذا الموضوع.
|b This thesis includes an examination of the forms of the implicit command and prohibition according to usuliyyun (Scholars of the principles of jurisprudence), an applied study of the understanding of these forms from Qur’an and hadith. This was done by looking at the books of the principles of jurisprudence in these forms and their implications in Qur’an and hadith. And refer to the books of interpretation of Qur’an and the Arabic language in the confirmation of these forms and their meanings. Then discuss these forms and their implications with examples from the Qur’an and Sunnah. By talking about the forms, I have extracted some of the controls to know the implicit forms of the command and the prohibition and know the importance of these forms and the reasons for bringing them in Qur’an and Sunnah. With an understanding of the reasons for the scarcity of this subject among the Scholars of the principles of jurisprudence. This work is divided into two sections: the first is the forms of implicit command and the second is the forms of implicit prohibition. Then I followed the research with the most important findings I have reached through this work. In the recommendations of the research, I concluded that it is necessary to take care of the implicit command and prohibition, and to conduct lengthy and detailed research on this topic.
