المستخلص: تمثلت مشكلة البحث الرئيسية في الحاجة الماسة إلى إرشاد السلطات التشريعية في البلاد الإسلامية وحثها للأخذ برأي علماء الأمة ومنهم ابن عابدين رحمه الله تعالى في تشريع العقوبات وتشديدها وفق الشريعة الإسلامية؛ للتصدي لجميع صور الجرائم المستحدثة التي تقع والتي تشكل اعتداء على المصلحة العامة، وهذا يستدعي البحث في الموضوع ودراسته، وهدف البحث إلى بيان رأى الإمام ابن عابدين رحمه الله تعالى في تغليظ العقوبة سياسة وإلقاء الضوء على موقفه من ذلك، والتعرف إلى الأسباب التي تدعو إلى تغليظ العقوبة عنده، وقد استخدم الباحث في بحثه المنهج الاستقرائي والوصفي، وخلص البحث إلى جملة من النتائج أهمها أن مبدأ تغليظ العقوبة مبدأ أصيل عند الحنفية، وهذا التغليظ يكون من خلال مراعاة أمور كثيرة لها أثر قوي في تكوين جنس العقوبة وتقديرها كالنظر في ظروف الجاني وبواعثه، والأثر الناتج عن الجريمة والظروف المحيطة بها كالزمان والمكان؛ كما تتنوع أصنافه، وأن الإمام ابن عابدين رحمه الله تعالى يرى أن المقصود من تغليظ العقوبة سياسة هو: استعمال السلطة التي منحتها الشريعة الإسلامية لولي الأمر في إمكانية تشديد العقوبة وتغليظها على الجاني في أحوال خاصة؛ بناء على تحقيق المصلحة ودرء المفسدة، وقد جاء كلامه في الموضوع مؤكداً ومفصلاً لمن سبقه من علماء الحنفية، ومبيناً وجه المصلحة في ذلك، ومخرِّجاً بعض الأمثلة والتطبيقات؛ بناء على ما قالوه وأوردوه في أمهات كتبهم، وأن أسباب تغليظ العقوبة عنده ترجع إلى أربعة: الدعوة على الجريمة، والمجاهرة بها، وقربها من جنس ما يجب به الحد، وعظم مكانة من ارتكبت في حقه، وأن منهجه في معالجة موضوع تغليظ العقوبة قد تميز بالتيسير، وذكر الأدلة والشواهد من القرآن والسنة، والاعتناء بتحقيق الآراء والأقوال، والاختصار وعدم الإطالة.

The main research problem was the urgent need to guide the legislative authorities in Islamic countries and urge them to take the opinion of the nation’s scholars, including Ibn Abdeen, may God have mercy on him, in the legislation and tightening of penalties in accordance with Islamic law. To face all forms of recent crimes that take place and that constitute an attack on the public interest, and this calls for research and study of the topic. The aim of the research is to clarify the opinion of Imam Ibn Abidin, may God have mercy on him, in the harshening of punishment politically and to shed light on his situation on that, And to know the reasons that call for harsher punishment for him, The researcher used the inductive and descriptive method in his research, The research concluded with a number of results, the most important of which is that the principle of harshness of punishment is an authentic principle according to the Hanafi school, This harshness be through by taking into consideration of many things that have a strong effect on the formation and evaluation of the type of punishment, such as looking into the circumstances of the offender and his motives, The effect resulting from the crime and the circumstances surrounding it, such as time and place; and Its varieties are also varied. That Imam Ibn Abidin, may God have mercy on him, sees that the intent of the harshness of the punishment politically is: Using the authority granted by Islamic law to the guardian in the possibility of aggravating the penalty and harsher punishment for the offender in special cases, Based on the realization of the interest and the prevention of corruption, it came on his speech in the topic were confirmed and detailed by those who preceded him from the Hanafi scholars And showing the interest in that and a way out Some examples and applications; Based on what they said and cited in the ummah of their books, And the reasons for the severity of the punishment in his view are due to four: The invitation of crime, profess it, its proximity to the gender of what the limit must be done, The greatness of the stature of those committed against him, That his approach to addressing the issue of increasing punishment was characterized by facilitation, The mentioned the evidence and testimonies from the Qur’an and the Sunnah, Taking care of the realization of opinions and sayings, Abbreviation and non-prolongation.
