يتناول هذا البحث مصطلح (المعمول به) وما في معناه عند الإمام المرداوي في كتابه: "الإنصاف في معرفة الراجح من الخلاف"، وقد جاء في تمهيد يشرح مفردات العنوان، يتبعه مبحثان، وخاتمة رصدت أبرز نتائج الدراسة، وأهم التوصيات. فكان المبحث الأول: في ذكر مواضع مصطلح (المعمول به في المذهب) ومرادفاته، وتحرر معناه. والمبحث الثاني: في ذكر مواضع مصطلح (عليه العمل) ومرادفاته، وتحرير معناه. وتظهر أهمية هذا البحث في كونه متعلقا بكتاب الإنصاف الذي يعد من أهم كتب الحنابلة المعتمدة، وأسماها منزلة، وأرفعها قيمة علمية. ومن أهم نتائج البحث: أن مقصود الـمرداوي بمصطلح (المعمول به في المذهب) وما في معناه؛ بيان أن تلك المسائل عليها العمل في مذهب الحنابلة بغض النظر عن المذاهب الأخرى. ومقصوده بمصطلح (عليه العمل) وما في معناه؛ بيان أن تلك المسائل قد جرى عليها عمل الناس في عصره ومصره، بغض النظر عن مذاهبهم ومشاربهم الفقهية. وأما التوصيات فمن أهمها: التوصية بتناول المصطلحات الأخرى الواردة في كتاب "الإنصاف" للمرداوي بالجمع والدراسة.
This research discusses the concept of (The Applicable) and what it means according to Imam Mardawi in his book: "Al'iinsaf Fi Maerifat Alrriajih Min Alkhilaf". It came in an introduction explaining the meaning of the title, followed by two chapters, a conclusion that monitored the most prominent results of the study, and the most important recommendations. First Chapter: Mentioning the places and synonyms of the concept (the applicable in the doctrine), and editing its meaning. Second Chapter: Mentioning the places and synonyms of the concept (the applied) and editing its meaning. The importance of this research is demonstrated by the fact that it relates to the Book of Al-Insaf, which is one of the most important approved Hanbali books, the highest in status, and the highest scientific value. One of the most important results of the research is that what is meant by Al-Mardawi in the concept (the applicable in the doctrine), indicating that those issues shall be complied with in the Hanbali doctrine regardless of other doctrines and what is meant by the concept (the applied) indicating that these issues have been applied by the people of his time, regardless of their doctrines. The most important recommendations are: recommending mentioning other concepts in the book “Al-Insaf” by Al Mardawi by collecting and studying.
