المستخلص: فالبحث يبرز موضوعا مهما في علم أصول الفقه، وهو ما يتعلق بمناط الحكم الشرعي ومراتبه، وقد بحثت ذلك عند الغزالي، وعند الشاطبي؛ لما للأول من تقرير لهذا المصطلح، ولما للآخر من تطوير له، فكان عنوان البحث "مناط الحكم الشرعي عند الغزالي والشاطبي". فشرعت في مناط الحكم الشرعي عند الغزالي، وبينت أن تنقيح المناط هو أول مصطلحات مراتب تحديد المناط ظهورا في كتب الغزالي الأصولية. ثم بينت مناط الحكم الشرعي عند الشاطبي، وذكرت أن مناط الحكم الشرعي له أهمية خاصة عنده، من جهة أنه كان المحور الذي تم على أساسه تقسيم الاجتهاد عنده على قسمين: اجتهاد لا ينقطع، واجتهاد منقطع، وذكرت أن النظر في تحقيق المناط يتنوع إلى نوعين: نظر في حقيق مناط الحكم في الدليل، ونظر في تحقيق مناط الحكم في الواقعة المراد معرفة حكمها. وتوصلت إلى أن الإمام الشاطبي في مرتبة تحقيق المناط قد سار على المنهج الذي خطه الغزالي، موضحا مكانة هذا النوع من أنواع الاجتهاد، ومؤكدا ما كان قد قرره الغزالي شارحا له، من أن الاجتهاد في تحقيق المناط ضرورة كل شريعة، إلا أن التطوير الذي أجراه الشاطبي هذا المصطلح يتمثل في تقسيم الاجتهاد في حقيق المناط إلى ثلاثة أقسام: تحقيق المناط في الأنواع، وحقيق المناط عينا، وتحقيق المناط الخاص، ثم بينت تقسيم الاجتهاد عنده على وفق مراتب تحديد المناط.
