المستخلص: من الواضح أن الصحفي يحب أن يكون له دور إيجابي في ممارسة مهنته، ولا يستخدم حقه بشكل سلبي، لكن الحال مع العديد من وسائل الإعلام تلعب دورا سلبيا، فنحن في حاجة ماسة إلى مراجعة هذه البديهيات. والتمسك بما خلقه الله للإنسان من مبادئ وأخلاق سامية وميل إلى مجتمع خيري. لاشك أن للصحافي دور مهم وفعال في المجتمع إذا أدار هذا الدور بشكل إيجابي. وإيصال رسالة هادفة مؤثرة للمجتمع، ومحاربة الفساد، وإبراز القيم الطبية، ونشر الوعي، والمفاهيم الصحيحة، وحماية الوطن، وتعزيز مفهوم الحقيقة والواقع والعمل والإنجاز وذلك بتوجيه نقده البناء والتزامه بمفاهيم الأخلاق وأخلاقيات مهنة الصحافة والالتزام بالنصوص القانونية. من ناحية أخرى لا ينبغي أن يتجاوز في حقه الذي يمنحه القانون والدستور، وخاصة عندما يكون عضوا مفيدا ومؤثرا في المجتمع، وذلك من خلال ممارسته الإيجابية لعمله وتغطية موضوعات إعلامية وأزمات ومشاكل من خلال نقل الأحداث والأخبار الواقعية والحقيقية وعدم تغيير أو تشويه أو تحريف الحقائق من أجل تحقيق أهدافه. ومن هنا تأتي مسؤولية الصحفي سواء كانت مسؤولية جنائية أو مدنية، وخاصة في ظل التقدم والتنوع في وسائل الصحافة والإعلام وتزايد المشكلات التي يخفيها استخدام هذه الوسائل، حيث انفتح باسم حرية الإعلام، والتعبير عن الرأي بطريقة تعسفية على حقوق الآخرين، وأصبحت وسائل الإعلام أداة للتوغل في داخل الآخرين. قد تكون الإساءة فعالة لدرجة الاعتداء على الحق من خلال نشر الصور الأخرى دون موافقتهم أو يتم التلاعب بها عن طريق تغيير الواقع، أو التشويه، أو التعرض لحياة الناس بكتابة مقال أو قصة أو رواية، وذلك للإضرار بسمعة هذا الشخص. لذلك حظيت موضوعات المسؤولية المدنية للصحفي باهتمام كبير، من خلال دراسة حقوقه وواجباته، حيث لا يمكن تحديد المسؤولية القانونية، سواء كانت جنائية أو مدنية، دون تحديد تلك الحقوق والواجبات التي تضررت، وذلك إن الكشف عن حقوق والتزامات ممارسة مهنة الصحافة هو أحد الأهداف الأساسية لهذه الدراسة، وإعادة النظر في قواعد، وأن القانون ينعكس في الموازنة بين حق الفرد ومهمة حقوق الغير، وحق المجتمع كإطار شامل، وفي هذا تكمن مشكلة الدراسة كما توضح أهمية دراسة موضوع المسؤولية المدنية للصحفي، حيث أن نظام المسؤولية المدنية يعد من أكثر الأنظمة القانونية شمولا حيث الحقوق والواجبات. رتبت لكل من تلك الناشئة عن العقد أو الضرر.

It is clear that journalists loves to have a positive role in the exercise of their profession, and do not use their right negatively. However, in this era due to many means of media it also plays a negative role. Therefore, we urgently need to review these axioms, and adherence to what Allah created for human of lofty principles and morals and a tendency to a charitable society. There is no doubt that journalists have an important and effective role in society if they manage this role positively. Delivering a meaningful and influential message to society, fighting corruption, highlighting good values, spreading awareness, correct concepts, protecting the homeland, and promoting the concept of truth, reality, work and achievement by directing their constructive criticism and commitment to the concepts of ethics and ethics of the profession of journalism and adherence to legal texts. On the other hand, they should not exceed their rights granted by law and the constitution, especially when they are useful and influential member of society, through their positive practice of their work and coverage of media topics, crises and problems by conveying real events and news and not changing, or distorting facts in order to achieve their goals. Hence the responsibility of journalists, whether criminal or civil, especially in light of the progress and diversity in the media and the increasing problems hidden by the use of these means inside others. The abuse may be effective to the point of violating the right by publishing other images without their consent or it is manipulated by changing reality, distorting, or exposing people's lives by writing an article, story or novel, in order to damage the reputation of this person. Therefore, the topics of civil responsibility of the journalist have received great attention, through the study of their rights and duties, as it is not possible to determine the legal responsibility, whether criminal or civil, without specifying those rights and duties that have been affected, and that the disclosure of the rights and obligations of practicing the profession of journalism is one of the basic objectives of this study. Moreover, reconsideration of the rules of responsibility is to achieve a balance between individual privacy and the need to preserve the general basic public order, and that the law is reflected in the balance between the right of the individual and the task of the rights of others, and the right of society as a comprehensive framework, and this lies the problem of the study as it shows the importance of studying the issue of civil liability for journalists, as the civil liability system is one of the most comprehensive legal systems in terms of rights and duties.
