المستخلص: تطرق المقال إلى نظرية العدالة كإنصاف لجون راولز، وبحث بالأساس في أدوات تحقيق العدالة ووسائلها. بدءا من تحقيق المساواة على مستوى التشريع لقواعد عادلة تنصف الأقل حظا، مرورا بضمان الخير والمنفعة للجميع بتوسيع قاعدة الاستفادة، لتشمل الأقل حظا من النساء والسود والمهاجرين... وانتهاء بمراجعة مجموعة من النظريات المهتمة بالعدالة، وعلى رأسها المنفعية التي اعترتها مجموعة من النواقص، فاستمر ظلمها لعدة فئات، وتضييعها لطاقات واعدة. أما أدوات هذه الدراسة فتتمثل في تحليل النصوص وتأويلها، بفتحها على نصوص أخرى، قصد استخلاص مجموعة من النتائج والتوصيات على رأسها: الاهتمام فعليا بالأشخاص الأقل حظا، وإيلاء مزيد من العناية من طرف الدولة والمجتمع للمهمشين وذوي الإعاقة... وذلك عبر صقل ملكاتهم وقواهم، وضمان مساواتهم مع غيرهم. كذا يمكن بلوغ نتيجة أخرى تخص دور الفرد وقدرته على صياغة نظام للعدالة متفق عليه ومتوافق بشأنه بعد نقاش يشارك فيه الجميع، ودون خلفيات مصلحية أو ثقافية... (حجاب الجهل). وفي الأخير تبرز نتيجة أخرى نحصرها في حاجة المجتمعات العربية اليوم لمثل هذه النظريات طبعا، بعد تبيئتها لتتلاءم مع طبيعة هذه المجتمعات.

The article touches upon the theory of justice as fairness by John Rawls, and mainly discusses the tools and means of achieving justice. It starts with the guarantee of equality at the level of legislation for fair rules to ensure justice for the less fortunate, passing through ensuring the good and the useful for all by broadening the basis of utility to include the less fortunate women, blacks and immigrants... and concludes with an overview of a set of theories concerned with justice, on top of which is the utilitarianism which has a number of shortcomings, It continues to oppress several categories, and wastes promising energies. As for the tools of this study, they appear in the analysis and interpretation of texts, by opening them to other texts and arriving at a series of conclusions and recommendations, chief among them: a real concern for the less fortunate, and greater attention given by the state and society to the marginalized and the disabled... through refining their faculties and strengths, and ensuring their equality with others. Likewise, another conclusion can be reached regarding the role of the individual and his ability to formulate a system of justice which is consensual and agreed upon after a participatory debate, and without interest or cultural backgrounds... (the veil of ignorance). Finally, another result emerges, which we limit to the need for such theories in today's Arab societies, once they have been prepared to fit the nature of these societies.
