المستخلص: إن النسخ الذي هو في الأصل أحد فروع علوم القرآن، وقد استقل ذلك الفرع أو الفن بعلم مستقل هو علم (الناسخ والمنسوخ) كانت له كنبه المستقلة، وعلماؤه الذين برزوا في بحثه، والمؤلفات في علم الناسخ والمنسوخ كانت أشبه ما يكون بتفاسير مختصة بالآيـات التي وقع فيه نسخ، أو وقع خلاف بـين العلماء في نسخها أو أحكامها، وكانت تركز على تحقيق وقوع النسخ أو عدمه، مع سوق أدلة بكل قول، و وجود النسخ في الشريعة له حكم عديدة، منها مراعاة مصالح العباد، ولا شك فإن بعض مصالح الدعوة الإسلامية في بداية أمرها، تختلف عنها بعد تكوينها واستقرارها، فاقتضى ذلك الحال تغير بعض الأحكام؛ مراعاة لتلـك المصالح، وهذا واضح في بعض أحكام المرحلة المكية والمرحلة المدنية، وكذلك عند بداية العهد المدني وعند وفاة الرسول صل الله عليه وسلم، ومن حكم النسخ أيضا ابتلاء المكلفين واختبارهم بالامتثال وعدمه، ومنها كذلك إرادة الخير لهذا الأمة والتيسير عليها، لأن النسخ إن كان إلى أشق ففيه زيادة ثواب، وإن كـان إلى أخف ففيه سهولة ويسر. وفقنا الله للعمل بأحكام شرعه، والفقه في أحكام دينه، ويسر الله لنا اتباع هـدي نبيه.

The abrogation, which is originally one of the branches of the sciences of the Qur’an, and that branch or art was independent of a separate science, the science of (Abrogation and Copied) had its independent books, and its scholars who emerged in his research, The works in the science of (Abrogation and Copied) were similar to interpretations specific to verses in which Copied occurred, or a dispute occurred between scholars regarding their abrogation or rulings, and they focused on investigating whether abrogation occurred or not, with evidence for each statement, We have seen the existence of copied in Sharia that has many rulings, one of which is observing the interests of the people. Undoubtedly, some of the interests of the Islamic call at the beginning of its matter differ from it after its formation and stability, so this situation necessitated the change of some rulings; Taking into account those interests, and this is clear in some of the provisions of the Meccan stage and the civil stage, as well as at the beginning of the civil covenant and at the death of the Messenger (may God bless him and his family and grant them peace), Among the rulings on abrogation is also the trial of the obligated and their testing of compliance and lack thereof, and also the desire for good for this nation and to make it easier for it, because if abrogation is more difficult, then there is an increase in reward, and if it is to a lighter one, then there is ease and facilitation.
