هذا البحث يناقش مشكلة اجتماعية ذات أبعاد أمنية خطيرة ألا وهي العضل وآثاره الاجتماعية والأمنية: دراسة فقهية، والعضل هو منع الوليّ لبنته من الزواج إذا تقدم لها الخاطب الكفء وقد يكون سبب ذلك طمعه في مالها من مرتب أو غيره أو ترفعه على الخاطب أو نكاية بأمها ونحو ذلك، ولا شك أنه حرام ولون من ألوان الظلم وصوره كثيرة ومتنوعة. والواجب الأخذ على يد الوليّ العاضل الظالم ونزع الولاية من يده ونقلها إلى أقرب الأوليّاء بعده حفظاً لمصلحة هذه البنت ودرءاً للفساد عنها؛ فهناك آثار اجتماعية وأخرى أمنية حتماً سوف تترتب على السكوت عن ذلك العاضل لعل من أبزرها: انحراف الفتاة وسلوكها مسلك الردى، وربما وقعت في المخدرات أو أقدمت على الانتحار للتخلص من نفسها، ولذلك نص الفقهاء على نقل الولاية من يد الأب العاضل وإسنادها إلى الوليّ الأبعد منه؛ بل حكم بعض الفقهاء بفسق الوليّ العاضل إذا تكرر منه ذلك، فهذا البحث يعالج هذه المشكلة، ويسهم في إيجاد الحلول الممكنة لها ويفتح آفاقاً واسعة أمام الباحثين لعمل المزيد من الدراسات والبحوث لاستقصاء حيثيات هذه المشكلة.
This research discusses a social problem of very serious security outcomes, which is "Al-Adul" (Grieve of daughter's marriage), and its social/security effects -Jurisdictional study - "Al-Adul" is the guardian's banning of the marriage of a daughter demanded for marriage by an efficient fiance. The reason for that may be his greed in her money of salary or the like, or his arrogance over the fiance or as a bothering to her mother and so on. No doubt it is forbidden and considered as a sort of grieve. It is a duty to stop grieving guardian who is practicing "Al-Adul" and transfer the guardianship from his hand to the nearest guardian next to him. Hence, we preserve the girl's interests and protect her from spoilage and corruption. There are social and other security consequences incurred by keeping silent towards that "Adulor"(The one who is practicing "Al-Adul"). The most conspicuous consequence may be the perversion of the girl. She might be indulged in drugs or tries to commit a suicide. Therefore, scholars have provided for the transfer of the guardianship from a father who is practicing "Al-Adul" (Adulor) and mandates thereof to the guardian next to him. Some scholars judged out immorality of the guardian who used to practice "Al-Adul" repeatedly. The research tackles this problem and contributes in finding possible solutions thereto. It provides an opportunity for other researchers to conduct more studies and explore findings of this problem.
