|a تناولت الدراسة فكرة الترجيح بين المصالح المتعارضة في فقه شيخ الإسلام ابن تيمية، والنظر في معالجته للمصالح المتعارضة، وكيفية النظر بينها عند تعارضها، وماهية خصائص الترجيح بين المصالح المتعارضة لديه، مع بيان تطبيقات ونماذج من فقهه -رحمه الله- تبين التزامه بمنهجية واضحة تجاه الترجيح بين المصالح المتعارضة. تهدف الدراسة إلى إبراز جهود الإمام ابن تيمية في مسألة الترجيح بين المصالح المتعارضة، وذكر بعض التطبيقات الفقهية المأخوذة من فتاوى الإمام. تكمن الإشكالية المحورية لهذه الدراسة حول مدى تعامل الإمام ابن تيمية مع قضية الترجيح بين المصالح المتعارضة. توصلت الدراسة لعدة نتائج من أهمها، أن مفهوم الترجيح بين المصالح هو تقديم إحدى المصلحتين لمزية من حيث القوة والأثر، وأن المصالح لها أهميتها في الشريعة في كونها أساسا للتشريع، وأن أهمية الترجيح بين المصالح عند ابن تيمية تتمثل في عدة أمور، منها: أنها من حقيقة الدين، ومن العمل بالرسالة المحمدية، ومن خصائص العلماء المعتبرين، وتقي من حصول الاضطراب في أحكام الشرع، وأن من خصائص الترجيح عند ابن تيمية التي تميز بها عن غيره، هي: استقلال الفكر، واهتمامه بمقاصد الشريعة، وحرصه الدؤوب على طلب الحق وإظهاره والثبات عليه، واستقراءه لمصادر الاستدلال، وانضباطه التام في ترجيحه للمسائل، وبينت الدراسة ورود تطبيقات فقهية كثيرة عن الإمام ابن تيمية تدل على علمه الدقيق بقضية الترجيح بين المصالح، والمنهج المتبع في هذه الدراسة، مكون من منهجين، وهما: المنهج الاستقرائي والمنهج التحليلي، حيث قام الباحثان باستقراء موضوع الدراسة من المصادر الأصلية، وتحليلها وتنقيحها وفق الخطة المقترحة؛ للوصول إلى النتيجة المرجوة.
|b The study dealt with the idea of weighting between conflicting interests in the jurisprudence of Sheikh al-Islam Ibn Taymiyyah, and looking at Sheikh al-Islam’s treatment of conflicting interests and how to consider them when they conflict, and what are the characteristics of weighting between conflicting interests with him, with a statement of applications and models from his jurisprudence- may God have mercy on him- showing his commitment to the rules of weighting between Conflicting interests deduced from the books of jurists- may God have mercy on them -. The study aims to highlight the efforts of Imam Ibn Taymiyyah in the issue of weighting between opposing interests and interest in jurisprudential applications taken from the fatwas of the Imam. The central questions of this study lie in the following: What is the importance of Ibn Taymiyyah's issue of weighting between conflicting interests? What are the characteristics of that to him? And what are the most prominent applications contained in this case? The study reached several results, the most important of which is that the concept of weighting between interests is to present one of the two interests to an advantage in terms of strength and impact, and that interests have importance in Sharia in being a basis for legislation, and that the theory of weighting between interests according to Ibn Taymiyyah is represented in several things, including: It is from religion and from working with the Muhammadan message, and one of the characteristics of respected scholars, and it protects against confusion in the rulings of the Sharia, and that it is only achieved with evidence and proof, and that adherence to it is considered from complete wisdom and reason, and that one of the characteristics of weighting according to Ibn Taymiyyah that distinguishes it from others, independence of thought, his interest in the purposes of Sharia, his tireless eagerness to seek the truth, manifesting it and steadfastness upon it, his extrapolation of the sources of inference, and his complete discipline in giving preference to issues. The study consists of two approaches, namely: the inductive approach and the analytical approach, where the researchers extrapolated the subject of the study from the original sources, analyzed and revised it according to the proposed plan; to reach the desired result.
