|a هدفت الدراسة إلى بيان الآثار القانونية للتداول بالعملات الرقمية على المؤسسات والأفراد، من خلال التعريف بالعملات الرقمية وتمييز أنواعها، والموقف القانوني من التداول بها، وما يترتب على ذلك من آثار، والمنهج المستخدم في البحث هو المنهج الوصفي التحليلي، كما تم استخدام المنهج المقارن لبيان الأحكام المشابهة أو المتباينة معها. توصلت الدراسة إلى عدد من النتائج منها أن هناك آثار للتداول بالعملات الرقمية على السياسة المالية عن طريق تأثيرها على حجم الإيرادات الضريبية المتوقعة أن لم يتم ضبطها بشكل حازم وقانوني، مما يشكل خشية من ترتيب مزيد من الالتزامات على متداولي هذه العملات من شركات ومستثمرين ومضاربين، وتم الخروج بعد من التوصيات منها ضرورة وضع تشريعات وآليات تضمن حقوق أطراف المعاملة من جهة، ومن جهة ثانية الرقابة على المعاملات الرقمية غير القانونية، والتي يدور حولها الشك، وإجراء تعديلات على قانون المعاملات وقانون الجرائم الإلكترونية والتي تنضوي تحته ما ينتج من مخالفات جراء التداول بالعملات الرقمية كونها تستخدم الحاسوب والإنترنت.
|b The Study aimed to clarify the legal effects of trading in Digital currencies on institutions and individuals, by defining digital currencies and distinguishing their types, the legal position on trading in them, and the consequences of that, and the approach used in the research is the descriptive analytical approach, and the comparative approach was used to clarify the provisions similar or dissimilar to it. The study reached a number of results, including that there are effects of trading in digital currencies on financial policy through its impact on the volume of expected tax revenues if they are not controlled in a firm and legal manner, which constitutes a fear of arranging more obligations on traders of these currencies, including companies, investors and speculators. Coming up with a number of recommendations, including the need to establish legislation and mechanisms that guarantee the rights of the transaction parties on the one hand, and on the other hand, to monitor illegal digital transactions, which are suspicious, and to make amendments to the Transactions Law and the Electronic Crimes Law, which includes the violations resulting from trading in digital currencies Because she uses a computer and the Internet.
