المستخلص: يقدم هذا البحث دراسة شرعية أصولية لمسألة مهمة من مسائل الفتوى الإلكترونية، ألا وهي الإشكاليات المتعلقة بمراعاة حال المستفتي الإلكتروني، واقتراح الحلول المناسبة لهذه الإشكالات، ويكتسب هذا الموضوع أهمية كبيرة خاصة بالنظر إلى التطور الإلكتروني المتسارع، والذي ينبغي أن تواكبه الفتوى ومراكزها في عالمنا المعاصر، ولذلك فقد رام الباحث جمع ودراسة أهم الإشكالات التي تواجه المفتي أثناء مراعاته لحال المستفتي في الفتوى الإلكترونية، فقام بعرض هذه الضوابط والمعايير، واقترح جملة من السبل والطرق والآليات الإلكترونية الحديثة التي تساعد المفتي على إصدار الفتوى الإلكترونية، وتذلل الصعوبات والعقبات التي تعترضه عند مراعاة حال المستفتي، ومن أبرز ما ذكره الباحث مما ينبغي على المفتي مراعاته من حال المستفتي في الفتوى الإلكترونية: مراعاة حاله من جهة فهم ألفاظ المستفتي وعباراته واصطلاحاته، ومراعاة حاله من جهة فهم المستفتي للفتوى، وتوضيحها له، وتهيئته لتلقي الحكم المستغرب، ومراعاة حال المستفتي من جهة عرفه ومذهبه، وتحدث الباحث عن مراعاة حال المستفتي في الفتوى الإلكترونية من جهة صدقه وتوبته، ومن جهة همته وقدراته وظروفه، ومع كل معيار من هذه المعايير المتعلقة بمراعاة حال المستفتي في الفتوى الإلكترونية، قام الباحث باقتراح الحلول الإلكترونية المناسبة لتحقيقها، وقد خلص البحث إلى جملة من النتائج العلمية والعملية المتعلقة بالفتوى الإلكترونية، وعدد من التوصيات الهامة.

This research tackles a fundamental legal study of the important issue of electronic fatwa (a legal opinion given by a religious scholar), namely, the problems related to taking into account the situation of the electronic investigator (mustafti: asking for fatwa), and proposing appropriate solutions to these problems. This topic is one of great importance, especially with regard to the rapid electronic development, which the fatwa and its centers and institutions in our contemporary world should accompany. Therefore, the researcher aimed to collect and study the most important problems facing the mufti (a religious scholar who gives fatwa) while taking into account the situation of the electronic investigator, so the study presented these restraints and standards, and suggested a number of ways and modern electronic mechanisms that help the mufti to issue the electronic fatwa, and overcome the difficulties and obstacles encountered when taking into account the situation of the investigator. Among the most prominent of what the researcher mentioned about what the mufti should take into account regarding the questioner’s condition in the electronic fatwa: is his understanding of the words, phrases and conventions of the investigator, and the investigator’s understanding of the fatwa, explaining it to him, preparing him to receive the ruling in case it is not clear, and taking into account the condition of the questioner in terms of his knowledge and doctrine. The researcher discussed the condition of the investigator in terms of his honesty and repentance, and in terms of his determination, abilities and circumstances. The researcher proposed the appropriate electronic solutions to achieve them, and the research concluded with a number of scientific and practical results related to the electronic fatwa, and a number of important recommendations.
