تبين الدراسة أن المرفق العام الوقفي وصف لكل كيان خدمي يهدف إلى تحقيق مصالح عامة، ويتم تمويل نشأته وتشغيله من ريع الأوقاف، ويتمتع بتنظيم إداري ونظام قانوني خاص، كما أن للمرفق العام الوقفي خمسة عناصر أساسية هي: - أنه مؤسسة عامة غير هادفة إلى الربح. - يتم تمويل إنشائه وتشغيله من ريع ما يوقفه الأفراد عليه. - يهدف إلى تقديم خدمات عامة مجانية. - يخضع في عمليات استبدال أصوله وملكية أعيانه لأحكام الوقف. - كما يخضع إداريا لإشراف الهيئة العامة للأوقاف. وبينت الدراسة بعض النتائج المهمة المترتبة على توفر هذه العناصر الخمسة في المرفق العام الوقفي. انتهت الدراسة في شأن تحديد الوظائف العامة الوقفية إلى إمكانية أدائها لنفس وظائف المرافق العامة الإدارية والاقتصادية والمهنية والوطنية. وأن التنظيم الإداري للمرفق العام الوقفي له قواعد، من أهمها: استهداف الشأن العام، والتمتع بامتيازات السلطة العامة، وبالشخصية المعنوية، والذمة المالية المستقلة. واقترحت الدراسة في شأن النظام القانوني للمرفق العام الوقفي خضوعه لنظام قانوني خاص يمزج بين قواعد القانون العام والخاص، ويراعي اعتبارات إنشائه من حيث اعتراف دولة الوقف بوجود خدمة عامة ذات نفع عام واجبة الإشباع عن طريق الوقف، ووجود قواعد نظامية تحدد الجهة المعنية بإدارته والرقابة عليه، ونظام المالي، كما يراعي كيفية وطريقة إلقائه وأساليب إدارته.
The study shows that Al-Waqf public service is a description for each service entity aiming to achieve general interest. It is operated and funded from Waqf funds in addition to having administrative management and special legal regulations. Public service has five main elements are as follows: • It is a non-profit organization. • It is funded and operated from the Waqf fund that the individual denotes. • It aims to provide free public services. • It is subject to the Waqf provision in its asset replacement and its ownership of property. • It belongs administratively to the General Authority for Awqaf The study showed some significant consequences of these five elements in the Waqf Public service. The study concluded that the identification of public Waqf functions could perform the same administrative, economic, pro- fessional, and national functions as public service. The administrative management for the public service has rules. The main rules of it are as follows: Targeting the public interest and having privileges of the public authority, legal entity, and independent financial liability. The study recommended in terms of the legal regulation for Waqf public service to be under special legal regulation that gathers public and private law rules. There are matters taken into account in its constriction such as Waqf state recognition of the existence of public service that has public interest needs to Waqf fund and the existence of the regulation defining the concerned authority through managing and monitoring them and the financial system. It also takes into account the method and channel of spending and methods of management.
