المستخلص: تهدف هذه الدراسة إلى التعريف بالاجتهاد التطبيقي، والتأصيل الشرعي للاجتهاد التطبيقي، كما تعرض نماذج للاجتهاد التطبيقي الذي كان يقوم فيه فقهاء الصحابة والمجتهدون. كما تعنى الدراسة بتطبيقات عملية للاجتهاد التطبيقي في مجال المعاملات المالية المعاصرة. ومن أبرز نتائج الدراسة أن عملية تطبيق الأحكام ينبغي أن يراعى فيها تغير الأعراف، وتطور الوسائل، وتغير المناطات، ومراعاة الظروف ومبدأ رفع الحرج، والتصور الصحيح للواقعة في ضوء الواقع وما يترتب على التطبيق من نتائج. وقد اتبع الباحثان المنهج الوصفي التحليلي من خلال التعريف بالمصطلحات، والمنهج الاستقرائي من خلال تتبع التطبيقات للاجتهاد التطبيقي وأثر الظروف في هذا الاجتهاد.

This study aims to define the applied Diligence and the foundations on which it is based, and the legal rooting of applied Diligence from the original and subordinating evidence. The study also deals with the impact of the celebrated circumstances on applied diligence, and the importance of taking into account the conditions of reality and expectations during implementation. The study is also concerned with practical applications of applied diligence in the field of contemporary financial transactions, taking into account the foundations of application, the most important of which is to pay attention to the jurisprudence of reality and expectations, and the jurisprudence of priorities and budgets. One of the most prominent results of the study is that the process of applying the rulings is a delicate industry that needs tools that a jurist or a mujtahid, an individual or a group, must possess, the most important of which is looking at the personal and objective circumstances of the incident and studying the impact of these circumstances during and after the application, The researchers followed the descriptive-analytical approach by defining the terms, and the inductive approach by tracking the applications of applied Diligence and the impact of circumstances on this Diligence.
