|a إن المشرع الجزائري من خلال دستور 2016 خطا خطوة إلى الأمام بالاعتراف الصريح بحق المواطن في العيش في بيئة سليمة تكفل له الحياة الكريمة وذلك في ديباجة الدستور التي أكدت على "بناء اقتصاد منتج وتنافسي في إطار التنمية المستدامة والحفاظ على البيئة" وتعززت هذه الحماية في المادة 68 منه التي اعترفت بصفة صريحة بحق المواطن في بيئة سليمة وضرورة حماية هذا الحق من طرف الدولة ومؤسساتها. وبذلك تكون الجزائر قد دشنت عهدا جديدا بمنح الحق البيئي قيمة دستورية عليا ملزمة لكل من الدولة ومؤسساتها.
|b The Constitutional founder of Algeria by the Constitution of 2016 a step forward unequivocally recognize the citizen to live in a healthy environment to ensure a dignified life and that in the preamble to the Constitution, which emphasized the "building product and competitive economy in the context of sustainable development and environmental conservation" and strengthened the protection in Article 68, which recognized him as an explicit right of citizens to a healthy environment and the need to protect this right by the state and its institutions. Thus, Algeria has launched a new era of constitutional right to grant the environmental value of the high binding on all of the state and its institutions.
