المستخلص: إذا كان حماية الطفل بصفة عامة من أولويات الدولة الجزائرية فان حماية فئة الطفل المسعف يعد من أهم الأولويات التي لابد على الدولة التكفل بها، لذا كان من اللازم إيجاد سبل مؤسساتية وقانونية تضمن توفير حماية خاصة لفئة الطفولة المسعفة باعتبارها فئة هشة ضمن فئة الأطفال، الأمر الذي دفعنا من خلال هذه الورقة البحثية إلى محاولة إبراز أهم وسائل حماية الطفل المسعف خاصة أمام الزيادة الرهيبة في عدد الأطفال المسعفين في الجزائر، لذا كان من الضروري البحث في وضعية الطفل المسعف وما يترتب على إدماجه في أسرة كافلة. وإبرازا لوضعية الطفل المسعف المكفول في إطار الكفالة في القانون الجزائري، اتبعنا المنهج الوصفي التحليلي للوصول إلى نتيجة مفادها أن المشرع الجزائري كرس حماية الطفل بصفة عامة والطفل المسعف بصفة خاصة جاعلا لجهاز القضاء دورا مهما في تتبع وضعية الطفل المسعف داخل العائلة الكافلة واتخاذ كل ما من شانه تحقيق المصلحة الفضلى للطفل المسعف وفقا لمقتضيات القانون

The protection of the category of the rescued child is one of the most important priorities that the state of Algeria must take care of. Therefore, it was necessary to find institutional and legal ways to ensure the provision of special protection to the category of child paramedic, as it is a fragile group within the category of children, which prompted us, through this research paper, to try to highlight the most important means of child paramedic protection, especially in view of the horrific increase in the number of paramedic children in Algeria, so It was necessary to research the condition of the child in the medical field and the consequences of integrating him into a foster family. In order to highlight the situation of the child paramedic who is sponsored within the framework of sponsorship in Algerian law, we followed the descriptive and analytical approach to reach a conclusion that the Algerian legislator has devoted child protection in general and child paramedic in particular, making the judiciary an important role in tracking the status of the paramedic child within the foster family and taking all of the It is to achieve the best interest of the paramedic child in accordance with the requirements of the law.
