المستخلص: إن الإكراه من أهم المباحث الأصولية فلا يخلو كتابا أصوليا عن الكلام عن الإكراه سواء في الأحكام التكليفية أو عوارض الأهلية، ولا شك أن للإكراه أثره في إسقاط الإثم والمؤخذة، وله أثره في تغير الأحكام المترتبة عليه، أما الحرمة فهي قائمة لا تتغير، فالإكراه لا يعدم الأهلية ولكنه ينقصها ويبقى المكره مكلفا، ولما كان الإكراه سالبا لرضا المكلف واختياره، وكان ذلك السلب مؤثرا في تصرفاته، وفي تغير كثيرا من الأحكام الشرعية، أحببت أن أكتب بحثا في هذا الموضوع "أثر الإكراه على تصرفات المكلف دراسة أصولية تطبيقية". وقد اتبعت المنهج الاستقرائي التحليلي النقدي، أما المنهج الاستقرائي فقد قمت بتتبع أقوال الأصوليين والفقهاء في مسائل الإكراه، وحصر المذاهب وأدلتها، وأقوال الأصوليين والفقهاء في المسائل الفقهية والأصولية، وأما المنهج التحليلي فقد سرت عليه بتحليل آراء الفقهاء والأصوليين في المسائل الفقهية والأصولية المتعلقة بالإكراه عند عرضها، واستنباط وجه الدلالة على مذاهب الأصوليين والفقهاء في المسائل المتعلقة بالإكراه، وثم قمت بالموازنة بين هذه الآراء حتى أتبين قوة وضعف كل فريق عند الترجيح بينهم، أما المنهج النقدي فيتجلى ذلك عند مناقشة المذاهب وذلك بذكر الأدلة والأجوبة عليها حتى نصل إلى المذهب الراجح. أما الخاتمة: فقد تناولت أهم النتائج التي توصلت لها خلال البحث ثم فهارس لما تضمنه البحث من مراجع، وموضوعات.

I followed the critical analytical approach, while the inductive approach has followed the sayings of the fundamentalists and jurists in the matters of coercion, and the restrictions and evidence of sects, and the sayings of the fundamentalists and jurists in jurisprudence and fundamentalist issues, and the analytical approach was made by analyzing the opinions of jurists and fundamentalists in jurisprudence and fundamentalist issues related to coercion when presenting them And deriving the face of the indication of the doctrines of fundamentalists and jurists in matters related to hateful, and then I bounded between these opinions until I showed the strength and weakness of each team when weighing them, while the critical approach is evident when discussing doctrines by mentioning the evidence and answers to them until we reach the most correct doctrine. As for the conclusion: I dealt with the most important results that she reached during the research, then indexes of the reviews and topics included in the research.
