المستخلص: يهدف هذا البحث إلى بيان الخلاف بين الحنفية والجمهور في معنى التأويل، ومقصودة، والفرق بينه وبين غيره من الألفاظ الشبيهة، وأثر هذا الخلاف في الفروع الفقهية؛ حيث إن الخطاب التشريعي في الكتاب والسنة معظمه بل جله صيغ بطريقة كلية، ومجملة، ويحمل الكثير من المعاني، والاحتمالات؛ بحيث يشمل جميع حوادث الحياة إلى يوم القيامة. ولم يقتصر هذا الخطاب على بيان الأحكام والمعاني من ظاهر النصوص التشريعية؛ بل تعداه إلى التأويل، والتفسير، وغيرهما، مستندا على الدليل من الكتاب، والسنة، وغيرهما من مصادر التشريع، وكذلك الحكمة التشريعية من النص، والقواعد الأصولية، والفقهية، وغيرهم مما يستند إليه المجتهد في فهم الخطاب، وكيفية استنباط الأحكام التشريعية منه. ولهذا اختلف الأصوليون في بيان وتفسير احتمالية تلك النصوص، وهذا الخطاب؛ في الدلالة على المعاني، وبيان مقصود ومراد الشارع منها. فاختلافهم في مفهوم التأويل، ومقصودة؛ بيانا لصدق هذا الخطاب، وتنزيله على الواقع حسب الظروف، والأحوال المعيشية. ورغم هذه الاختلافات الناتجة عن اختلاف فهم كل متأول؛ إلا أنها لم تكن متعارضة بشكل كلي؛ مما يؤكد على صحة القول بأن هذه الشريعة منسجمة تمام الانسجام، ومتفقة تمام الاتفاق مع بعضها البعض دون تعارض فيها.

This research aims to illustrate the disagreement between Alhanafiyah and Algomhour regarding the definition of Hermeneutics, its purpose, the difference between it and other similar words, and the impact of this disagreement in the jurisprudential branches. The legislative discourse in Quran and Sunnah is mostly or maybe entirely formulated in a holistic, syntactic manner, bearing many meanings and possibilities to include all life acts until the resurrection. This speech was not limited to the statement of provisions and meanings on the face of legislative texts; It goes beyond Hermeneutics and exegesis, and so on, based on evidence from Quran, Sunnah, and other sources of legislation, as well as legislative objective from the text, rules of Alosoulion, doctrine and others on which the diligent is based to understand the discourse and how legislative provisions are derived. Alosoulion therefore disagreed on stating and finding explanation of the likelihood of such texts, and this speech (in terms of meaning) intentional statement, and the purpose of the street. Their different viewpoints regarding the definition and meaning of Hermeneutics is a vivid proof toward this subject. Furthermore, these different viewpoints make this subject down- to- earth depending on its circumstances and living conditions. Despite those differences arising from the differing understanding of each Hermeneutic text, they weren’t entirely opposed, and this assures that the parts of Shariah are consistent and compatible with each other entirely without any form of contradiction.
