المستخلص: تناولات هذه الدراسة عنوان: مرتكزات تحقيق التعايش السلمي في ميزان الفقه الإسلامي. يدور الحديث هنا حول موضوع التعايش السلمي بين أفراد المجتمع الواحد من مسلمين وغير مسلمين، وعلاقة الفقه الإسلامي بهذا الموضوع المهم الذي عليه مدار قيام الدول وتقدمها وتحقيق رفاهيتها، وبيان أن التعايش السلمي مما قررته شريعتنا، وهذا دليل على صلاحية الشريعة الإسلامية لكل زمان ومكان، وأنها جاءت بمصالح العباد، كذلك في هذا البحث بيان واضح للشريعة الإسلامية في تكريمها لبنى الإنسان، وأن أساس التكريم لم يبن على أساس دين أو لون أو عرق بل لكونه إنسان سخر الله له كل ما في الكون لخدمته، ومن ثم يتكون هذا البحث من مقدمة وتمهيد ومبحثين وخاتمة، وقد اتبع الباحث في هذا البحث المنهج الاستقرائي التحليلي الذي يساعد على جمع واستقصاء ما يؤثر في تحقيق التعايش السلمي وتحليل علاقتها بتحقيقه. وتوصل إلى النتائج الآتية: - منها الخروج بعلم الفقه من حيز النظرية إلى حيز التطبيق، وأن التكريم الإنساني يجعل الجميع متساوين في الحقوق والواجبات، ومن ثم يحقق مبدأ الانتماء الوطني، ويحقق الألفة والمودة بين أفراد المجتمع على اختلاف طبقاتهم وظروفهم وأحوالهم، كذلك حرية الاعتقاد هو أول باب التسامح بين أفراد المجتمع المختلفين في الاعتقاد والدين، وهو وسيلة المودة بينهم؛ فينعم أفراد المجتمع بمجتمع هادئ خال من الاضطرابات والنزاعات والمشكلات بين أفراد المجتمع، كما أن التسوية بين الخصمين إذا كان أحدهما غير مسلم تدعو إلى العدالة، وإلى بيان فضائل الإسلام، وما فيه من مزايا فاضلة، وسجايا حميدة.

This study deals with the title: Pillars of achieving peaceful coexistence in the balance of Islamic jurisprudence. The discussion here revolves around the issue of peaceful coexistence between members of the same society, Muslims and non-Muslims, and the relationship of Islamic jurisprudence with this important topic on which the foundation of states, their progress and the achievement of their well-being revolve, and the statement that peaceful coexistence is among what our Sharia has decided, and this is evidence of the validity of Islamic Sharia for every time and place, and that it is It came with the interests of the servants, as well as in this research, a clear statement of Islamic law in honoring the human being, and that the basis of honoring was not built on the basis of religion, color, or race, but rather because he was a human being, God subjected everything in the universe to him to serve him, and then this research consists of an introduction, a preface, and two discussions Finally, the researcher followed the inductive and analytical approach in this research, which helps to collect and investigate what affects the achievement of peaceful coexistence and analyze its relationship to achieving it. It reached the following results: Including the exit with the science of jurisprudence from the realm of theory to the realm of application, and that human honor makes everyone equal in rights and duties, and then achieves the principle of national belonging, and achieves intimacy and affection among members of society of different classes, circumstance and conditions, as well as freedom of belief is the first chapter of tolerance between members of society Those who differ in belief and religion, which is a means of affection between them; The members of society enjoy a peaceful society free from disturbances, conflicts and problems between the members of society, just as the settlement between the two opponents if one of them is non- Muslim calls for justice, and for explaining the virtues of Islam, and its virtuous advantages and praiseworthy attributes.
