|a الأصل في الاستعمال الحقيقة، أي استعمال عقد الوكالة بمعناه الحقيقي وما يتضمنه من أركان وشروط ومنها من حق الموكل أن يعزل وكيله إلا أن هذا الحق ليس بحق مطلق يملكه الموكل ويستعمله متى شاء، بل هو مقيد بعدم تعلق حق الوكالة بالغير، بل سارت بعض القوانين على سحب هذا المبدأ على الوكيل وألزمته بالبقاء على وكالته إذا تعلقت هي الأخرى بحق للغير، وفي حالة تحقق هذا الأمر (تعلق الوكالة بحق الغير) لم يكن باستطاعة الموكل عزل وكيله، ويتقيد حق الوكيل بعزله لنفسه حفاظا على مصالح الغير. ومصدر هذا الحق قد يكون التشريعات القانونية وقد يكون اتفاق الطرفين ..ألا أن الوكالة غير قابلة للعزل لم تحظ بتنظيم قانوني مستقل.. ولم نجد لها إشارة ألا في نصوص خاصة وبعض القرارات القضائية، ولم باهتمام الفقه القانوني العراقي بشكل موسع. وكذلك الشريعة الإسلامية منحت حق الموكل أن يوقف الوكيل أو يقوم بعزله متى ما شاء، إلا في بعض الحالات وذلك حينما تتعلق الوكالة بحق الوكيل أو غيره أو في بعض الوكالات التي تسمى بالوكالات الدورية، وإن كان هناك بعض الاختلاف بين الفقهاء من ناحية كونها جائزة شرعا أم لا لذا نجد أن مصطلح الوكالة غير قابلة للعزل غير واضح ويشوبه غموض خصوصا أن بعض النصوص الخاصة أشارت إليه بشكل بسيط. علما أن المشرع العراقي قد اعتمد على الفقه الإسلامي في الكثير من تشريعاته.
|b The origin in use is the truth, i.e. the use of the agency contract in its true sense and the elements and conditions it contains. Among them is the right of the person to dismiss his agent. However, this right is not an absolute right, and the person may not use it at any time .Rather, it is a restricted right that the agency’s right is not related to a third party. Some laws have prohibited this right to the agent and obligated him to maintain his agency if it is also related to the rights of others. In the case that this matter is achieved (the agency is related to the right of others), the person was not able to dismiss his agent, and the agent's right is restricted to his own dismissal in order to preserve the interests of others. The source of this right may be the legal legislation or the agreement of the two parties. However, the Agency did not regulate independently. We did not find a reference to it except in some texts in particular and some judicial decisions, and it did not receive sufficient attention from Iraqi legal jurisprudence. Likewise, Islamic law granted the right to the person to stop the agent or dismiss him whenever he wanted, except in some cases, when the agency relates to the right of the agent or others, or in some agencies called periodic agencies, although there is some difference between the jurists in terms of being permissible legally or not. Therefore, we find that the term irrevocable agency is not clear and ambiguous, especially since some special texts referred to it in a simple way. Note that the Iraqi legislator relied on Islamic jurisprudence in many of his legislations.
