المستخلص: اعتبر الأفراد مستفيدين لكن ليسوا أصحاب حقوق، حيث كانوا يعتبرون موضوعات للحماية ولكن ليسوا مواضيع فعلية للقانون الدولي لحقوق الأنسان أو القانون الدولي الإنساني، فيما يتعلق بالتعويض، ولكن فيما بعد نالت قسطا وافرا من الاهتمام على الصعيدين الوطني والدولي، ولم يعد من المقبول التركيز على حقوق الأنسان دون النظر في حق الضحية، وهو مسار انتقل من انعدام تام لأبسط الأدوار وممارسة كافة الحقوق التي يمكن أن تعود إليهم من طرف الدولة إلى تحديد فئة الضحايا ومشاركتهم بصفة مستقلة عن الدولة إن الحقوق التي يجب أن يتمتع بها الإنسان في ظل متغيرات دولية متسارعة، هي السبيل الوحيد لاستقرار الدول داخليا ودعم واستقرار الأمن والسلم الدولي وتعد حقوق الضحايا من مواضيع القانون الدولي الأكثر أهمية على الصعيد الوطني والدولي باعتبارها لم تنل قسطا كافيا من الاهتمام، واعترف لها بمجموعة من الحقوق، التي لم يكن الوعي بها في الفترات السابقة، حيث كثيرا ما تم تجاهل حقوق هذه الفئة، كونها غابت عن المشاركة في المحاكمات التي أقيمت لمرتكبي الجرائم الدولية ولم يتجاوز دورهم حد الإدلاء بالشهادة، وانعدمت الموازنة بين فئة الضحايا وفئة المتهمين وتتضمن حقوق الضحايا؛ الحق في الحماية، الحق في المشاركة في الإجراءات، الحق في التمثيل، والحق في جبر الضرر.

Individuals were considered beneficiaries but not rights holders, as they were considered subjects of protection but not actual subjects of international human rights law or international humanitarian law, with regard to compensation, but later they received a great deal of attention at the national and international levels, and it is no longer acceptable to focus on human rights without considering the right of the victim, a path that has moved from a complete lack of the simplest roles and the exercise of all rights that can be returned to them by the state to determine a category Victims and their participation as independent of the State. The rights that human beings must enjoy in light of rapid international changes are the only way to stabilize States internally and to support and stabilize international peace and security. he rights of victims are one of the most important topics of international law at the national and international levels as they have not received enough attention, and a set of rights have been recognized for them, which were not aware of them in previous periods, as the rights of this category have often been ignored, as they were absent from participating in the trials held for perpetrators of international crimes and their role did not exceed the limit of testifying, and there was no balance between the category of victims and the category of accuse. The rights of victims include the right to protection, the right to participate in proceedings, the right to representation, and the right to reparation.
