|a تناول هذا البحث موضوعًا مهمًا وهو "حكم تحريم زواج المسلمة من غير المسلم، ومقاصده" في الشريعة الإسلامية؛ وذلك لما يعيشه العالم اليوم من انفتاح واسع على بعضه البعض؛ وللشبه والآراء المختلفة التي اعترته؛ حاولت أن أسبر غوره بما لا يدع مجالًا للشك حتى نكون على بصيرة خصوصًا لأبناء الجاليات المسلمة في ديار الكفر، ليتعرفوا على أسباب تحريمه وفق شرعنا الحنيف، ولكن هذا وغيره جاء البحث للوقوف على حالاته ومآلاتها من ناحية الحكم الشرعي لنحافظ على نسل وعرض المسلمين من كل دخن. جاء البحث في مبحثين: الأول: في بيان معنى الزواج، ومشروعيته، وحكمه، وأركانه، وشروطه، والثاني: في حالات حكم تحريم زواج المسلمة من غير المسلم، ومقاصده. توصل البحث إلى نتائج مهمة منها: اتفاق الفقهاء قديمًا وحديثًا على حرمة زواج المسلمة من غير المسلم ابتداء ودوامًا، سواء كان كتابيًا أو غير كتابي. وأن هذا التحريم مردة الحفاظ على المقاصد الكلية الضرورية التي جاء بها شرعنا العظيم: "الدين، والنفس، والعقل، والنسل، والمال"٠.٠٠ إلخ وقد أوصى البحث ببعض التوصيات منها: ضرورة الاهتمام بأبناء الجاليات المسلمة في ديار غير المسلمين من حيث ربطهم بالقرآن، والسنة تربية، وإعدادًا، وتثقيفاً، وقيام المجامع الفقهية بدورها المنوط بها من ناحية دراسة النوازل المجتمعية التي تنزل بساحة الجاليات المسلمة في البلاد غير المسلمة.... إلخ
|b This paper discussed an important theme which is “The Ruling of Prohibiting a Female Muslim from Marrying a Non-Muslim, and Its Objectives”. under the Islamic Sharī’ah. This was based on the contemporary wide openness on the global level, and for the various confusions and opinions as a consequence. The researcher made effort to give an in-depth consideration of the issue in a way that would prove the extant position beyond any reasonable doubt, in order that clarification is made, most especially for the children of the Muslim diaspora communities living in non-Muslim countries, for them to know the grounds for its prohibition in our pristine religion. For this reason and others, the research was prepared to illuminate its instances and consequences in terms of the Sharī’ah ruling, so that that Muslim progeny and honour will be preserved from any blemishes. The paper is made up of two topics: the first: on the meaning of marriage, its legality, its ruling, its pillars, and its conditions. And the second: on the instances of the ruling of the prohibition on the marriage of a female Muslim from a non-Muslim either initially or perpetually, whether the non-Muslim is a Christian or Jew or not. And that this prohibition is intrinsically premised on preserving the basic and essential objectives that were brought by our great religion, viz.: “religion, life, mind, progeny, and wealth”. The research made some recommendations, including: that it is imperative to give attention to the children of the Muslim diaspora communities living in non-Muslim countries in terms of connecting them with the Qur’an and the Sunnah, for the sake of education, preparation and enlightenment, and for the Fiqh councils to continue to carry out the roles it were saddled with in terms of studying the societal novel issues among the Muslim diaspora living in non-Muslim countries.
