|a إن المشرع الجزائري ومن خلال جل تشريعات الوظيفة العمومية المتعاقبة جعل شرط الجنسية على رأس الشروط للولوج للوظيفة والاستمرار فيها، بحيث أن زوال الجنسية بسبب من الأسباب يؤدي لا محالة إلى فقد صفة الموظف العام وانتهاء العلاقة الوظيفية ومنه تبرز العلاقة القائمة بين الجنسية والوظيفة العمومية. وهو ما يعد بمثابة الهدف المنشود من وراء هذه الورقة البحثية، والتي تم التوصل من خلالها إلى جملة من النتائج مفادها أن الجنسية ليست بالرابطة الأبدية بين الفرد والدولة، فقد تنقضي بسبب من الأسباب المحددة حصرا في قانون الجنسية الجزائرية وطالما أنها تعد شرطا أساسيا للالتحاق بالوظيفة العمومية وشرطا للاستمرار في العمل فإنه بالتبعية يترتب على فقدانها أو التجريد منها انتهاء الخدمة وفقدان صفة الموظف.
|b The Algerian legislator, through most of the successive civil service legislation, has made the nationality condition at the top of the conditions for access to and continuation of the job, so that the demise of nationality for one of the reasons inevitably leads to the loss of the capacity of the public servant and the end of the job relationship, and from it the relationship between nationality and the public job emerges. Which is the desired goal behind this research time, through which a number of results were reached that citizenship is not an eternal bond between the individual and the state, it may expire due to one of the reasons specified exclusively in the Algerian Nationality Law and as long as it is a prerequisite for joining the public office As a condition for the continuation of the work, the consequent loss or stripping of it results in the termination of the service and the loss of the employee’s capacity.
